Clamper loses in court

There was a link here but I am not allowed to put it in! If you look at today's Yorkshire Evening Post "leedstoday.net" you will find it.
This person made his case under the "no contract formed" argument. The clamper says he is appealing and interestingly he says he has been to court many times and not lost. There is no evidence to support this claim but I suppose a piece in the paper is not the place to tell everyone the details of these cases.

    On the subject of trying to get money back from clamping firms:-

    Justice Secretary Ken Clarke's department is preparing plans to get tough on rogue traders who ignore CCJs.
    A consultation paper is due this spring. There were one million CCJs issued last year but almost one in four went unpaid.

    That doesn't make sense, there was a court case betweeen a motorist and a clamper, the motorist won.

    Did the clamper win the case as well, or did he lose? (did the court rule for or against the clamper?)

    It raises an interesting but simple point I think...can we help people get around the clampers' final extortion attempts this year by saying: if you get clamped and you see no immediate option but to pay, make sure it's by a trackable method proving that it WASN'T the driver who paid?

    The article says that the owner had lent his car to his brother - so only the brother could ever have been alleged to have entered into the clamper's shoddy 'contract'.

    So, the owner of the car comes along, and HE pays under protest to get HIS car back.

    He wasn't the driver so he can then take the clamper and retailer/managing agent/landowner to Court, allege all the usual stuff about signage, SIA licence etc. but can also state that HE categorically did not enter into any contract whatsoever...how can a judge refuse?

    The owner can also claim for loss of use of the car, as in this case!
