Insurance Nightmare - need help

    No - they want convictions over last 5 years to be disclosed.

    The DL problem will be down to poorly trained staff - though insurance service staff aren't really the authorities on legal matters like this!

  • Thanks everyone. My husband has a broker he uses for his business motor insurance policies so I'm going to ring him tomorrow and see what he can do for us in terms of a new policy given the fact that DL won't confirm NCD.

    When I told DL I would probably cancel the renewal which is due to start on 15/2 they said because I had already accepted it there would be a cancellation fee. This would be applied regardless of whether the policy had commenced or not.

    It's an SP20 on his licence - not sure if that makes any difference - someone mentioned an SP30.

    Since neither of us has any previous endorsements I didn't expect it to appear on the policy and was stupid enough to think that having advised DL and noted date and name of the person I spoke to that would be sufficient. You live and learn:(

    I may email DL complaints tomorrow to see what the response is to the previous years charges.

    What worries me even further is that given the lack of police action and the possibility of the hit and run driver denying liability for the accident the claim could drag on for months before we finally end up settling ourselves as we have a £400 excess. Apparently I would have had better cover if I'd been hit by an uninsured driver - go figure.

    I'm not sure any other insurer would be interested in taking us on if the NCD couldn't be validated for some time. Worth a call to the broker I think.

    No, SP20 is the same as all speeding endorsements, it does have to be disclosed to insurers for 5 years, (and cannot be removed from your licence before 4 years).

    Complain to DL. Complain about DL. And don't do it by email either, do it in writing and send it Recorded Delivery (you don't want them to 'accidentally' lose that one as well, so you?).

    Might be worth giving the Police a poke too. They will probably say that it's a civil matter because it was on private land (which is true), but it's also criminal damage (which is a police matter). Driving right at you is also an assault and quite possibly something even more serious.

    I was thinking email as it was quicker than snail mail but I guess if I did the letter tomorrow and sent it next day delivery it would only be 1 day longer before they got it.

    Poking the police is proving difficult - the car park was a local council one but because I wasn't hurt and there is no CCTV to back up my story they aren't too bothered. They've pretty much said that if they visit the car owner and she denies it they can't proceed further. There will be damage to her car (providing she hasn't repaired it in the 3 weeks which have now passed) but they say that doesn't prove anything.

    So it would appear you can cause damage to someone else's property, then drive directly at them, presumably to scare them, and as long as there no witnesses then when the police show up you just deny it. That wasn't my understanding of british justice but I learn something new every day just now.

    There has to be some irony in the fact that his speeding conviction was collected when driving a tractor. He has never been allowed to forget it:)

    As you are intending making the claim off your own policy, then your excess will be payable anyway, (and you will need to pursue the third party to recover it and all your other uninsured losses).
