I don't what is so difficult to understand, it's simple:
Car is taxed and on public road - insurance is needed.
Car is off-road and SORN is in place - no insurance is needed.

Except as I described earlier, if the tax disc is free, there is currently no point in returning it and declaring SORN.

You don't have to return it, you can just declare SORN which over-rides the tax disc in force.

Worringly, none of the advice on those sites says that one of the options when you get the love letter will be to simply declare SORN. All they talk about is buying insurance or face a fine. Lets hope that's an oversight.

Declare SORN and remember to categorically insist that you did declare SORN on day 1, and DVLA has lost your application - not your fault.

It also states if you don't receive an acknowledgment letter after 4 weeks to contact DVLA, and you can SORN through the Internet so no lost application.

I don't know what point you are trying to make, but the main point is, and you may not be aware of this:

THERE IS NO LEGAL REQUIREMENT TO CHASE THE DVLA FOR AN ACKNOWLEDGEMENT OF SORN. YOUR ONLY LEGAL REQUIREMENT IS TO SEND THE DECLARATION.

Ok then, so the same can be said about not receiving your refund after 6 weeks to contact them to chase it up, as you say your only requirement is to send it off and wait.

Your (new) point has no relevance.

    OK, I accept that.

    Perhaps I should've said...
Except as I described earlier, if the tax disc is free, there is currently no point in [STRIKE]returning it and[/STRIKE] declaring SORN.

    Hope that helps. :D
  • My car tax is payed until may 2013, but my insurance is due to expire at the end of Dec. I am banned for driving until April 2013.
Why in my case I need to insure the car ? (nobodyelse is driving this car.)

I think the rules are quite specific...if the car is taxed it has to be insured.

If you are not driving it I would "cash in" the tax, and sorn it until you are able to drive it again..

No insurance then you must SORN the car. Sending the tax back for a refund.

If its a couple of weeks then you swing it out but not 3 months, They will send you a fine long before then for having no insurance and not declaring SORN.

Just make sure its off the road on private land where you have permission to park it.
