Vodafone changed T&C's which affects me, enough reason to getout?

Hi,

To keep a long story short, I took out a deal with Vodafone in July 2010, its a 18 month deal and a cashback one. However, as soon as into the contract a month later I had called vodafone to see if I can downgrade, I was told that I would need to wait until after 9 months before I ask them to downgrade and I was asked to call back around Feb 2011.
Now I have contacted Vodafone and asked them to downgrade, blimey...I was told they changed the Terms and conditions from the 1st of January (never received any communication from them) and now I can no longer be able to downgrade the tariff. I called their CS and they are useless....CSA even went on to say that they can now send me a text to confirm the changes to TCs.

NOw, is it enough of a ground to terminate this contract? I am really frustrated with Vodafone's CS who were very rude and unhelpful in resolving this matter.
Peers any advise is greatly appreciated

thanks

The newer YPL (Your Plan) tariffs where your are unable to downgrade were intoduced at the beginning of 2010, and if you upgraded July 2010, you would have been automatically put on a YPL Plan and downgrading would never have been an option.

If you check your online account you will be able to find out which price plan you are on.

Here are two previous threads where the subject of downgrading a Your Plan tariff have been discussed.

If you were able to downgrade, not quite sure how that would affect your cashback.

one thing I am confused about is why were I been advised after a month into the contract by a Vodafone CS and I would be able to downgrade. I know the difference between YPL and myne is not a YPL....
because I had taken from DAP and I quiet remember that after I had taken this contract the plans were slightly changed as my friend had tried for the same plan couple of weeks later than me.

But my point is if vodafone had changed their TC's they are supposed to write me first before even implementing them.

DAP would allow you to claim your cashback even after you downgrade your tariff.

    Hi Narika,

Have you checked your online account or called Customer Care to find out which price plan you are on ?

If you are able to downgrade, it may affect your cashback, it could be worth checking that out.

    Thanks for your reply.
if you go through my first post carefully, I had been advised by vodafone as soon as I had taken out the contract that I could be able to downgrade. Now the priceplan that I am on is irrelevant is not it? you know where I am coming from? I had confirmed that I could be able to downgrade not from one CS but two of their CS staff had confirmed it for me last year. I had specifically asked the CS to leave a note on my account regarding the downgrade so that is there on their system too.
how can that be all of a sudden changes exactly at the time when Vodafone stops downgrading!!! fishy! bunch of jokers voda really are.

The changes in their T&Cs are not a reason to get out of a contract. You signed an 18 month contract andf therefore you are tied to that contract for 18 months. Previously they 'kindly' allowed you to downgrade your contract after a period of time, they have now removed this option. This has not changed what you are paying or what you are getting for you money.

It ios possible that if you spoke to a CSA just after the rule changed that they gave you incorrect (out of date) info.

Because handsets are subsidised firms seem to be clamping down on any options that dont require you to stay on the same tariff or for the full period.

changes to T&C's without informing the customer are I believe enough of a reason to get out of contract. Correct me if I am wrong. Ofcom's 9.2 directive clearly statest htat any changes need to be notified to customer IN WRITING. In this case i had not received any sort of communication from the vodafone.

There was no change in Terms and Conditions. You signed up and agreed to a YPL Plan which cannot be downgraded.

In return for your commitment, you will have received a heavily subsidised phone and more for your money, including the possibility of cashback.

Like it or not, you have signed up to a YPL contract and those are the T & C's you have agreed to.

I have been with VF for years and have 2 contracts. I have NEVER come across a monthly with phone tariff that allowed you to downgrade after 1 month. Even when they allowed you to downgrade after 9 months that was only in £5 steps down to the lowest tariff of that type available. This meant if you were on a £24.99 tariff you could go to a £19.99 one and even then a £14.99 one but if the lowest was £15.00 you had to stay at £19.99.

What exactly does it say your tariff is on you bill/statement?
