Jobseekers rejection

My wife was made redundant 2 weeks ago - She has just had her claim for Jobseekers (C) Rejected on the grounds that she has not paid enough NI - because she only worked part time (prior to being made redundant 2 weeks ago) - despite having paid £1000's in NI for over 25 years !!
She earned around £150 per week (20 hour week) - is there any point appealing ?
She is only entitled to about £1000 redundancy too - she worked for the company for 2 years and is owed last months pay (the company finances has not been sorted yet - but owes £500k to creditors). When will my wife get her money and from whom - since the company owns ziltch ??

If she's been earning over the lower limit for tax and NI it doesn't matter that she's been part time. At £150 pw she must have been paying tax and NI so I have no idea why the records show she hasn't sufficient contributions. Perhaps it's something to do with the company?? I would certainly appeal and let them look into it futher.
Depending on your wage and/or savings she might not have entitlement to any means tested benefits I'm afraid despite 20 years of paying in.I'll get you, my pretty, and your little dog too!0 -
Thanks - so if she has paid *any* NI - this counts ?0

It's over the previous two tax years. Here's a link with some details.

No, she needs to have paid 2 full years of N.I. contributions in the appropriate claim years. If she's been earning £110 a week for the last two years she should have paid enough N.I. contributions for benefits.
The first thing to do is to contact the HMRC to ask for a statement of account. This will tell her what N.I. contributions the HMRC believe she has paid. She can then compare the statement of account with her P60s/payslips to ensure the totals correlate. You can get a statement of account by contacting the HM Revenue & Customs (HMRC) National Insurance Enquiries for Individuals Helpline on 0845 302 1479 (textphone 0845 915 3296). The helpline is open from 8.00 am to 5.00 pm, Monday to Friday except bank holidays.0 -

If her company is insolvent and won't pay her statutory redundancy payment then she can claim it from the National Insurance Fund. The link below provides details on how to do this and also how to work out a redundancy payment.

A little off topic, but this should help you work out how much NI she has paid, that way you can present it in the appeal:
http://listentotaxman.com/
Type in her tax code, and her yearly wage and it gives you a result under "yearly" for NI contributions. Don't forget to include that in any appeals you make. Hope this helps.0 -

Tax years and benefit years are different.
For tax years it is NI paid in 2008-2009 and 2009-2010.

As your wife's ex employers are in financial difficulties, is she sure that they've actually been handing over her NICs? It might also be worth checking that they've been paying her tax as well.0

To help speed things up, send copies of your wife's P60's for the last 2 tax years - 08/09 & 09/10 - to the JCP Benefit Centre that decided her JSA claim. Explain about the company, and that maybe, as others suggest, the NIC may not have been paid to HMRC. With this info JCP should contact HMRC.0
