Urgent debt relief order help!

Options
I really need to get something cleared up because I'm nearly pulling my hair out....I applied for a DRO 2 months ago through an agency called olive branch. The guy was nice and helpful and when I sent my paperwork back he told me it would be done within 2 weeks. It's been 2 mOnths now and it still hasn't been processed. I'm receiving debt letters and calls in which I have told them that I've applied for a DRO and everytime they say I need to send them the paperwork when I get it back. I've called the debt agency about 15 times now and everytime he says it's being processed and is almost done. He said that my creditors know and I should just keep telling them about my DRO.
Now it's getting stupid and I'm really panicing...I've just recieved a court summon in 3 weeks. I phoned the creditor and he said that he hadn't been told about any DRO and I should get proof from the agency. I phoned the agency and again he said it was almost done and this was all to be expected. He said that he's been calling the creditors and they know About the DRO but are pretending not to, to make me panic and pay up. This is all starting to stress me out as I don't know what to do! Should I believe him???!! Also another question...when I applied I was £14,000 in debt but now it's taken so long it will have gone over the 15,000 limit because of charges. Will I be rejected now? Please any advice or similar experiences?! Should I see CAB about it?

    Hi there,

Sorry I am not great on DROS.

    Sounds like a nightmare:eek::eek:

I would contact CAB or one of the charitys as soon as possible.

The only approved intermediaries for a DRO are:
    • CAB
    • CCCS
    • National Debtline
    • Institute of Money Advisers
    • Payplan
    • Baines & Ernst
So I'm unsure how this other debt agency could do a DRO for you.

I'd ask them this question Monday morning, and also get advise from one of the ones who can do a DRO for you after that.

Authorised intermediaries can be found here:

hate to say it but the fact that their website isn't even complete doesn't exactly fill me with confidence! If i were you i'd go to the CAB on monday and get it sorted through a proper channel before it gets to court. Good luck.

I'm almost frightened to ask this question, but how much did you pay for the DRO through them?

Sorry but I smell a GIANT rat, and if they had done what I think they have done, and it can be proved with the paperwork, it could be a complaint to the MoJ and a very fast withdrawal of licence! (Hint: They are NOT a licensed intermediary, and there is no trace on the MAT framework indicating any staff members are either!)

    OK VERY IMPORTANT UPDATE

    OLIVE BRANCH

ARE OPERATING ILLEGALLY, THEIR MoJ LICENCE HAS BEEN CANCELLED, WHICH MEANS THAT THEY CANNOT BY LAW PROVIDE ANY FINANCIAL SERVICES

    Evidence: HERE

The original poster may well have LOST any monies they have given across to the company.

They will now need to follow the advice given by the Ministry of Justice

    Here

Oh how I HATE CMCs they MUST be banned!!!

  • Well...I'm not surprised if you're right. Looking back at it all, it is really dodgy. But I don't get how they can get away with it. Surely they would have done it to others? I've spoken to 3-4 different people there and they told me to refer the creditors to them...so surely they wouldn't say that if eventually it's going to cause trouble? I don't get it. But say it does turn out to be a con...could I nail them? What evidence would I need?
I paid them £175 as they promised to get it done faster than CAB. I was stupid to just go with it but I was desperate to get it sorted asap and found them just by typing in "apply for DRO" on google. I'm not sure if they happened to be in manc where I live or the website referred me to them. They took the £175 out if my bank account so there is a record of it.
  • Jesus...so what do I do now? :/
