After eight weeks from the date they received your complaint, you can refer the matter to the FOS.
Edit
The FOS website gives you more information on their complaints procedure.Warning: In the kingdom of the blind, the one-eyed man is king.

Escalate to the FOS.
They need a kick from somewhere.0 -
Thanks, do I need to send them a letter first saying I am doing this or just go ahead and go to FOS?0

Check the date you first complained (you can reasonably argue that's when you first made them aware of your concerns, it doesn't have to be the date you first wrote) - if 8 weeks have passed then just escalate it.
I reckon somebody's moved your loan account off an old computer system that understood your agreement and shoved it on to a system better designed to do other things. They don't know how to deal with it!0 -
Well FOS questionnaire filled in and ready to print off and send with documents - hopefully get the money back in interest I've been charged I shouldn't have then can get the whole loan paid off and be rid of this incompetent company :j0

Might be a good idea to check your credit file to make sure they haven't wrecked it for you. You will want any of their adverse entries removed as part of the settlement. You might want to include this request in your questionnaire to the FOS.

Do you think there is a way this could have been affected just by them having my APR wrong?0 -

Oops !
Sorry, a cross-threaded brain on my part.
No. If you have been paying regularly on time then there is no reason that your credit file should be affected. Apologies again.Warning: In the kingdom of the blind, the one-eyed man is king.

Any ideas anyone how long it normally take to get a reply from the FOS?
I sent my form off and copies of letters from Santander on 7th April but have had nothing yet even to say they are looking into it etc?
In the meantime, Santander have sent me another letter again going on about the "Flexible Loan" I had which is still incorrect and stating as they are correct it was Flexible they can change the APR but obviously they are wrong!
Should I sent this letter onto the FOS also and if so how as I have no reference number etc from FOS?
Santander are really annoying me that they are not even reading my letters correctly. I wronte back explaining it wasn't Flexible and clearly they have just ignored that!
Thanks x0 -

I think a phone call to FOS (See post #22 website for telephone numbers) might be a good first move. You can then also confirm their receipt of your complaint.Warning: In the kingdom of the blind, the one-eyed man is king.
