    Hi there

    Lots are in the same position at the moment, and mine are still sitting with the bank and have been since before Christmas, but I do have that option of leaving my complaints with them, or complain to the FOS.
    We "may" hear some news over the next month or so, but not sure of the JR decision, this can yet take more time.

    Only you can decide from here what you want to do, but please be aware you may also be waiting some time before your complaint gets dealt with by the FOS as well, due to high volumes of complaints, and they are rising too, so its difficult to predict who will be quicker really.

    Either way, good luck on your reclaiming.

    thx for the reply , but the thing is im no expert in these matter and more confused now as to what to do, and my situation is also not very good either. bcoz i know JR decisions will drag .
    please post ur thoughts and also if any suggestions that will be a great help

    So have you sent the letter to make a reclaim?

    There is a reclaiming questionnaire on the 2nd link posted above, stage one of reclaiming, that replaced the template letter on this site, the FOS issued these to save time later on, so if you were not happy with the final decision made by the business dealing with your complaint, you can send the FOS a copy.

    Of course you can write a letter in your own words if you prefer, I see you have posted a letter above.

    They have 8 weeks as you know to make a decision, and if they need more time they should let you know, but as long as the 8 weeks have passed and you have received the final decision/this one should include details of the FOS if eligible, they will confirm this in the final decision.

    When your making a reclaim, make sure you pursue the ones who sold and set up your account, and forward your complaint to the head office or the complaints dept if they have one.

    i have already posted the letter to the bank complaints dept on 16th feb (which is the letter on the top my 1st post)
    Recieved a reply from them after a week
    Having reviewed your complaint we can confirm that we are unable to provide a final response to your complaint at the moment and would like to explain why this is so and the implications of this for you.

    The standards against which you complaint should be assessed, namely the Financial Service Authority(FSA) policy statment on the PPI compaints and guidance published by the Financial Ombudsman (FOS) are the subject to legal proceedings between the British Bankers Association(BBA), the FSA and the FOS.

    In August 2010, the FSA published new requirements concerning the way in which the industry should handle customer complaints about the sale of PPI policies. the BBA (the main trade association for UK banks) believes that these requirements go beyond the rules and regulatory requirements in force at the time of the sales. Accordingly, the BBA has sought clarification from the Court on that aand on a related point concerning complaint handling by the FOS.

    The BBA intends to work with the FSA and the FOS to ensure these matters are resolved as soon as possible. Once the court has provided clarification as to the standards against which your complaint should be assessed we will then be able to make a final decision.

    In the meantime:

    1. we have registered your complaint in our records.
    2. we will keep you infirmed if there are material developments in the court case that affect you complaint and
    3. we will revert to you once the matter has been resolved through the court
    4. we confirm the time for the court to make a decision will not prejudice your complaint in relation to calculating any time bar periods or timeframes for referring your complaint to the FOS

    You don't send a letter to FOS, you fill out a form;

    I would also be written to the bank again asking them what grounds do they have to hold your complaint because the banking regulator to which you are a signatory has stated there is no hold and that claims should not be held up because of the judicial review.

    Clearly they are side stepping there own regulator namely the FSA

    i was thinking to go through a ppi no win no fee firm
    because my credit cards are also charging me ppi so want to deal with them as well
    has anybody heard of brunelfranklin or can anybody suggest any good third party agency dealing with ppi's

    heard the good news about the court decision on ppi reclaim. I want to write to the Financial Ombudsman about my ppi reclaim. Could anyone please help me with the format of the letter which i should write to the ombudsman.
