talk talk contracts

i have tried to get a mac code from tiscali(talk talk) but they say that i have agreed a contract with them which has a further 5 months to run ,i cannot remember agreeing to a contract when i previously asked for a mac code and they gave me 3 months free useage to stay with them any suggestions?

    I doubt they would give you 3 months free without something for them on the end of it. How long ago was that?
    If you wanted to leave, why accept a further 3 months of TT?
    You can still get your MAC, but you'll have to pay an ETC if you are still in contract.
    No free lunch, and no free laptop ;)

    Pretty much the same thing happened to me about 6 months ago, they told me my broadband was going from £10 to £15 a month & from unlimited to 20gb a month. I was a Tiscali customer so had long been out of contract so rang to ask for my mac code & they offered to reduce it back to £10 with 3 months free, but NO mention of a new contract.

    They failed to make the changes though & kept billing me for £15 so I had to keep ringing & they kept lying & failing to keep promises.

    I have only just found out that they signed me up to a new 18 month contract in Oct 2010 without me agreeing to it.

    They have to tell you of any changes to your account, and legally cannot tie you to a contract if you have not agreed to it.

    I got so frustrated with all of TT's customer service staff being so useless that I emailed the CEO's office & one of her "team" is dealing with it.

    If you didn't agree to a contract & don't want it then argue it, they can't hold you to something you didn't agree to.

    Its an old trick they tried on me when I complained once. "Would you like 3 months free". I refused the offer but was still signed up to an 18 month contract without my knowledge.

    Fortunately all calls are recorded, so the OP should complain to high level complaints (use the email floating around on this site for charles dunston), they'll listen to the tape, decide the contacts null and void, and the OP can get a MAC.

    These issues were meant to have been resolved last year, but talktalk are reactive, not proactive, over this issue of misselling.

    They cannot refuse you a MAC, even if you are still in contract. But if you use it, they'll try to stitch you up with an ETC.
    I don't follow the timescale on this though-if the free 3 months started 3 months ago, and they say there is still 5 months to run, that is an 8 month contract. All TT contracts are 18m or 12m surely?

    Yes, I'm aware of that, but what are TT claiming? If they say that the OP started a new contract 3 months ago, and it now has 5m to run, that is an 8m contract. They don't do 8m contracts, so clarification is needed.

    At the end of the day if you ask for a Mac Code regardless of if your in or out of contract it should be given to you, its as simply as that!

    Of course what you have neglected to mention is that if TT sign someone up to a new contract without their knowledge & they ask for a mac code without knowing they have been duped then TT will try and hammer that customer for leaving whilst "still in contract".

    If that did happen then it would be investigated and if found to have been extended without the consent of the account holder they wouldn't be held to it...
