Santander - Major C***-up - Poor service.

    I'd keep going asking for more money. Three or four hundred pounds is not really that much. I got £150 when they took months to send me a Tax Deduction Certificate (I complained to the Chief Exec, and asked for £300). An inconvenience, but not more.

    They seem to be perpetrating identity fraud on you, which seems much more serious. On a quick scan of your complaint, they also seem to be breaching the Data Protection Act.

    I would ask for a token sum like say £1000. IANAL but I can't see how they can claim that you have accepted any amount as final settlement just because they have put it in your account.

    I would certainly complain to the regulator, and also to the Data Protection Registrar. Do you think they have really fixed it?

    I would also write to their current Spanish boss, copying your long story. Complaining is the best way to get some of our money back from banks, when they are paying such low interest rates.

    Finally, tempting though it is to make money by complaining, do as I say not as I do and leave Santander!

    Well I am raising a separate complaint regarding the latest statements (when I can find where I put them).

    As for the rest of it - maybe £400 (£700 between us) is not enough, I got the feeling I could have probably pushed for more. But then again, I am not greedy and have suffered no real loss (thankfully) or major distress. As such, the compensation I have managed to secure comes in at the top end of what the FOS recommend for this sort of issue. If I take it any further, which I am still considering, it will not be for the money.

    Re: your last line - I am already moving my accounts to Lloyds (in fact most of my DD's are now set up with my new account)

    I completely agree with Kulath's suggestions but I've a suspicion that you won't get very far.

    I base this on my sister's case where £20,000 was taken fraudulently from her account on the very day it had been credited by Abbey as part of the mortgage (inside job ?). After 6 months of hard work on our part she go the money back, plus £300 compo. They told us that their policy is to never pay more than £300 unless instructed to do so by the ombudsman.

    Re the 2 statements - it used to be the case (banking law) that statements had to be sent to all parties of a joint account, unless each party agreed to just one statement (most banks had the customers sign a simple form). I assume this rule is still in place.

    Good luck in getting as much as you can from them - whatever they pay you will not make up for all the inconvenience and worry they've put you through.

    Which is why I am jumping ship. The money I have got is no where near as much as I would like, but knowing the scales the FOS go by I am happy with what I have received. As I said above, I am not greedy - I think that may be the reason they did not quibble with the amount I asked for - because I didn't ask for a stupid amount to start with.

    It is a bit drawn out isn't it. Oh well, nearly over now. I'll sort the Statement names out when I can be bothered (too much else to do right now) and see if I get any more from that, but ATEOTD we have screwed £700 out of them (not a bad figure) and they are losing my accounts. To me that has WIN written all over it.

    wow ! what a thread :eek:. You have more patience than me thats for sure. I'd have blown the roof off SEVERAL times if it was me in your situation.

    I'm a bus driver - I have to have patience ;)

    I just hope that this thread has been helpful to others. One main thing I gleaned from this - just because Santander send you a letter stateing "full and final settlement" you can still argue the toss and get more out of them.
