I only take the company car through the automatic car wash, never a car I care about.
The very nature of these machines means your paintwork is going to get scratched, usually they're small enough that you don't notice except in direct sunlight (the infamous swirl marks).
There's no cycle in these machines to clean off the brushes between washes, so even if they take them out daily and wash them (hint: they never do this) if the car that went in before you happened to have been parked in front of a building site all day, then all the little chunks from their car will now be stuck in the brushes just waiting to be rubbed all over your car.
That said, scratching the window is pretty extreme! Is it a straight line scratch or a curvy one?
Hmmmm and idea ask to see the videos of the cars that went through the car wash before you as if Lum is right in his assumption then that would back up your case for compensation.0 -
It was an example, not an assumption.
Chances are any CCTV will be such low resolution you wont be able to tell anyway.0 -
Has the OP got any news on this please?PLEASE NOTEMy advice should be used as guidance only. You should always obtain face to face professional advice before taking any action.0

The signs are legally meaningless. Bit like writing 'sold as seen' or 'no warranty given' ect.
Agreed. As a consumer, you have some legal rights that cannot be excluded. Other Contract terms which are not illegal outright can still be deemed "unfair" by a court, and excluded.
Whether or not "no liability for damage" is an unfair term is obviously open to debate!
Have a look at:
The Unfair Terms in Consumer Contracts Regulations 1999

Unfair Contract Terms Act 1977 (particularly section 2)

The earth needs us for nothing.
The earth does not belong to us.

Actually the 2nd sign is spot on. You can only be held neglient if you have been neglient or breached a duty of care. Tesco are saying in the sign if we are neglient your covered otherwise your not.
As for the post. It depends on the scratches. I've yet to find a car wash that doesnt leave some small blemishes/scratches and its routine; If they are extremely deep then you might have more of a case but you will need to prove it.
I actually have used a car wash with the oversized mop things recently and I will confess I thought there were a few more noticeable imperfections afterwards.0
