Has a seller ever 'won' a dispute?

    I've only ever had two cases - won one (and got a neg and 1*s across the board for my trouble) the other one I just caved and issued a refund as soon as it was opened, even though it was over an item that I had sold literally hundreds of.

    I won one last month. Sold a laptop, a Thinkpad X61s, to a buyer in Spain who was a computer shop. The laptop had a BIOS password on but only the supervisor one so you could alter most stuff, upgrade it, install an operating system on etc and the stuff protected you'd not change anyway. Anyway, the unoffical way to clear the BIOS password is to short out the chip holding the data on it but you can kill the laptop if you get it wrong. I don't bother because the password has no effect at all and if you didn't tell people there was one, 99% would never find out but I'm honest so I do...

    Sure enough, a fortnight after arriving, in comes the claim for SNAD - buyer claiming laptop arrived dead and Paypal have deducted the money from my balance. I told my half of the story, that this was a £1500 when new laptop that is noted for its reliability, that it had a password on as described in the auction and I suspected he had tried to remove the password by non-official means and blown the motherboard. He was told to send it back but strangely it never arrived - probably because I put tags on and you have to break one of the tags to get to this chip... A couple of weeks later, they found in my favour and restored the money.

    Have you really had nothing to laugh about since January.

    I've had plenty of things to laugh about since January, and this was another one.

    So because I treat my buyers properly and get treated well in return and rarely if ever have problems I am not a genuine seller? So for all the others who don't really have issues an don't find selling on ebay difficult- you are not a genuine seller-(not sure I understand that reasoning, but hey ho|)

    Has happened to me a few times, two items were not found anywhere so presumably either someone has stolen them or the courier has not dropped them off at all and pretended to do so (I would want to believe that the latter is highly unprobable) - of course Paypal did not want to know as the item tracked as "delivered" and I ended up with massive losses.

    I agree with you 100% Smit1970. I give you credit when you say it is a gamble because it is.

    People say "if you dont want to use ebay there are pleanty of other places" the system should just be fair instead of asking people to gamble when they don't want to. Sellers get no protection at all.

    And I'm not referring to just powersellers either. I used ebay as just a jo bloggs seller, selling bits and bobs to make money and clear out the flat and I still got burnt. I think it feels worse when your that type of seller.

    In fact I have been advised in many threads to stop complaining about ebay and not to use it if I don't like it. So now I don't. In fact I operate my own personal embargo on ebay and instead I use free advertising and I've save a hell of alot of money on fee's.

    The feedback system is a joke too, but that's a story for another time.

    It's never happened to me so I can't comment directly. I believe that if you can prove delivery to the correct address you will win a INR case. I appreciate you have been a victim here but it would be unfair to expect the seller to refund you as all they can see is the item has been signed for. In this situation it is far more likely the buyer is trying it on and certainly the seller hasn't done anything wrong. If you were to take it up as a legal matter it would be the courier you would need to sue, not the seller. The system is nowhere near perfect but there is far more protection for buyers than sellers.
