BNWOT Item received Dirty!

Hi, I won a clothing item on ebay and when it came it appeared to have marks on it coming through from the inside. I turned it inside out and it is covered in brown dirty splodges - maybe make up or fake tan. As the item was sold as BNWT I think it's unnaceptable and I want a refund. I have e-mailed the seller and they have basically said no I can't have a refund as the item is not "not as described" I believe it is "NAD" as you wouldn't expect a new item to be dirty.
I want to open a case against the seller - what are my chances or winning?
Also someone mentioned I need to open the case with Paypal and not ebay - how do I do this?

Thanks I am just so annoyed the seller has said it's as described - you wouldn't buy a new top in the shops covered in fake tan.

Well I e-mailed her straight away with the problem and she e-mailed back saying had I tried washing it? I e-mailed back saying no but it shouldn't be dirty as it was described as brand new and I would like to send back for a refund. She ignored this message. So I e-mailed her again asking if she got my previous message and to let me know where to send it back to and she wrote back I will not refund as it's not "not as described".
I don't think she will refund now unless ebay force her - unfortunately the resolution centre seems to have an error at the moment not letting me file a dispute.
Maybe I should message her saying thanks for letting me know she will not refund and saying I will open a dispute as soon as I am able?0 -
I checked her feedback she has 100% but she has 3 neutral all saying there items were dirty with what looks like fake tan - and I checked her feedback left and she has purchased lots of xen-tan so I think we have a definite culprit lol.
I would wash it if it was another item but it's a jumper than it very fluffy and delicate and personally I would handwash to keep it in nice condition and be gentle with it so scrubbing dirty brown marks off is going to ruin it.0 -
Don't bother wasting your time with her. She won't change her mind, these people seldom do, so it'll be better for you to sit down, relax a bit, not let it upset you and open the dispute when it's ready.
I know you're hopping mad, but cooling off and then opening the dispute when you can will make it much more effective from her point of view.
When you leave the neg, leave something calm and firm like "Item came covered in fake tan and make-up - not NWOT" and leave out anything that will make you look bad - like "buyer beware", "avoid", or too many exclamation marks. That will hurt her more, doubly so if she throws a wobbly and leaves a nasty follow-up which makes her look dickish. It may be the final nail in her coffin - with that feedback, no-one will buy from her.

How much did you pay? If you open a dispute, you have to pay the return tracked postage, so if the item wasn't too expensive, it might not be worth it, and better to just leave a neg.Should've = Should HAVE (not 'of')

It was £20 - to be honest it's not really about the money anyway but more the principal x0
