I bought an iPhone 4 eight days ago. I finally got to use it yesterday as it took that long for the PAC code to be issued and the number assigned.

I've had terrible reception problems and have hardly been able to use the phone. Sometimes the screen doesn't respond to my touch despite service being available.

I phoned 3 tonight and they said the phone mast close by has a fault on it and is being worked on. They don't know how long it will take to fix.

Does anyone know if the 14 day return policy only applies to changing your mind provided you don't use it all (thats what it says on the docs they gave me) or if I take it back now to the shop will they replace it with another iPhone 4 which I would like as I'm still in the 14 day rule and I think there's a fault with the phone apart from the phone mast problems.

Read the docs again. Three are very specific, if you use the phone at all, even just turning it on, you void the14 day return policy, so taking it back is not an option under that.

However as the phone appears faulty thats a different matter the policy doesn't apply

If there really is a mast issue then a new phone may not resolve it, try going somewhere else and seeing if it persists, to try and work out if it's a mast issue or the phone.

Three will in all likelyhood direct you to Apple for a repair, legally Three are responsible, but you'll get a faster service from Apple.

Try the shop first but if they insist they can't swap it then it's best if you deal with Apple direct. If you have one nearby book a "Genius Bar" appointmenet in an apple store and they will probably swap it out, otherwise Three will most likely want to send it back to Apple, a process you can do yourself with less hassle.
