Hang on people, lets remember one thing that is a fact here... The assesment methods are up the creek (as we all agree) but the last thing we want is any negatives. I am sure none of us would be wanting to cause ourselves further grief by "commiting fraud"

I have learnt very quickly that in the appeal process you can (in your own words) dispute "what was said" and any tests that were not or were undertaken.

End of the day, your doctor and any othe professional services (OT etc) will fight you case for you if it is just and these are qualified to do so.

These forums are here to help people not cause further anguish for genuine people with sincere and real life changing problems

Recording covertly isn't fraud, though, and such recordings can be submitted as evidence for an appeal.

If anything, using recordings is a means of avoiding fraud committed by ATOS, to the detriment of the patient.

I've done this myself, and even went so far as to state my reasons in writing why it was recorded.

And if I ever have to attend another assessment, I'll do the same thing again.
  • With my doctor I simply showed him the info I had received and he simply said "as far as I am concerned, due to your mental condition, you are not fit to work"

I suggested in my appeal that they contact the doctor as previoulsy they had not. I guess it will drag on until I am left with no money and still not able to work after which God knows.

Thanks guys, I'm wondering if Brian has actually BEEN to an ATOS medical before? I think those of us who have will understand what each other are talking about. I'm definitely appealing, I won it last time and there's no reason at all I won't win it again. I will be okay to work part time again IF the DWP give me time to get well and get Pathways' help to find a suitable job with suitable hours where I won't end up having another breakdown, and I'll get off this horrible vicious circle!!

Its like the mile high club...many talk about it without having experienced it.

Sadly ATOS has too be experienced too understand how they can blatantly say one thing while the opposite is true.

So a Nurse (in my case) knows more about about my condition in 30 mins than my specialist and my GP both of whom have been treating me for 5 years.

Hmmm now doesn't that tell you something....
