ATOS Medical - failed, advice please?

    Thanks guys, I'm wondering if Brian has actually BEEN to an ATOS medical before? I think those of us who have will understand what each other are talking about. I'm definitely appealing, I won it last time and there's no reason at all I won't win it again. I will be okay to work part time again IF the DWP give me time to get well and get Pathways' help to find a suitable job with suitable hours where I won't end up having another breakdown, and I'll get off this horrible vicious circle!!

    It's a shame that the reports do not specify ANY of that. It doesn't say what work should be avoided, what work the patient's capable of, what work may be therapeutic - nothing.

    And for it to be called a 'Work Capability Assessment', you'd think the points made above would be addressed in such a report.

    I totally agree with that, it's FAR too general!

    And if ATOS are going to declare me 'fit to work' then it would be nice if the report wasn't full of lies where they haven't taken any notice of what I've said or hospital reports and letters I've produced!! Of course they can decide I'm fit for work if they just ignore everything in front of them!?
  • I recently had a medical for Industrial Injury Disablement benefit, the "medical" was carried out by atos, the medical deemed me to be disabled, i passed it and was awarded the benefit, and even tho i passed it the report was still full of lies and mentions things that didnt even happen....

    "the customer was able to remove his overcoat and remove his shoes and socks without assistance" - pack of lies, my wife helped me remove my cardigan (not an overcoat) and at no point in the "medical" was i asked to remove my shoes or socks.

    this is what gets my blood boiling....

    "after the examination, the customer put back on his shoes and socks, without assistance and put on his coat and scarf without hesitation...."

    I HAVE NEVER IN MY LIFE OWNED A DAMN SCARF!!!!!!!!!!!!!!!!!!!

    why are they able to put such lies down in these reports and get away with it.

    it borders on slander to be honest.

    just one point worth noting, you didn't fail the medical, you passed it.
    you failed to get the result that you wanted , thats different.

    still doesnt make it right....

    and i fail to see how ATOS' medical deems me to be disabled yet the one i had for esa says im fit for work....

    the lies they told in the report will go against me as ive sent off a copy of this to the esa people regarding my appeal.

    they lie through their !!!!ing teeth and get away with it.

    All the evidence (apart from some very dodgy DWP reports that contradict their later research) shows that the system is majorly flawed to a massive extent.

    Any idea how long my current appeal has been ongoing? Two years now, still waiting.

    Indeed, they will, for now anyway, thanks to harringtons report though, that may stop later, as its provided a nice get out clause for them.

    Be warned though, I too have asked for them to record, which they did, and they STILL lied in the report despite it being officially recorded.

    And they made me sign a document stopping me from using the evidence in any legal complaint against the assessor to the GMC/police/courts etc. I can only use the tape for obtaining benefits purposes (ie esa tribunal).

    So - record it covertly, or take legal advice over having to sign anything before you go.
    Even if you have legal certainy you dont have to sign, still record covertly, as ATOS would be likely IMO (and from my experience) to FORCE you to sign, if you want the tape.
