hi not sure how to word this but i was living with my partner and i found out on sat that he has been sexually abusing my 12 year old daughter for over a year he has been arrested.
i have applied for tax credits i work 32 h a week and get about £15000 a year i have 2 children 12 and 10 i work out i should get about £120 a week from tax credits and single person occ on the house. i have a mortgage so dont get housing ben.
what i was wondering is am i entitled to anything else? i have to pay all my bills on the 1st and get paid weekly he got paid monthly so i have put nothing by to pay them his wages didnt go in so im assuming he has stopped them im really scared and dont know what to do my mum and dad are paying my bills this month but tax credits said it will take 10 days for the forms and 3 weeks for claim to be processed.
is there anyway things can get sped up due to the circumstances?
the children are not his so he doesnt have to pay for them
its a joint mortgage does he have to pay his share?
womens aid have been very helpful and seen a solisitor any advice or help would be greatly appreciated.

Hi there , I don't feel the circumstances will have any bearing on your claim, any break down of a relationship is traumatic for the people involved whatever the circumstances. What help do you get from your Childs biological Father? You need to speak to a Solicitor re the house/mortgate, if your ex ends up in prison then surely he has no way of paying. You can then explore the possibility of buying him out or selling up. In the interim maybe speak to your bank and see if u can make an token payment whilst things are sorted. Or could you ask his Mum if he intends paying anything towards it whilst on bail?0

Hi there
I have been a lone parent for over two years. My ex still has his name on the mortgage as this was the only way I could keep the house. This had no effect whatsoever on my tax credit claim. To get by for now I have gone on an interest only mortgage as I can't afford to by ex out and the mortgage company would say no anyway as I don't earn enough.
I also reduced my hours which was the best thing I did as my tax credits increased and childcare costs reduced.
I suspect that you will want to cut all ties with him so maybe you should speak to the CAB about buying him out or selling up.
I was also told up to four weeks for my new claim but it actually took just two days.
Good luck.0 -
Your latest ex may not be the father of the children concerned, and so not liable for child support - but is their biological father still around? He should be providing financial support for the children, and you can get that started by contacting the CSA.0

the children have not seen there dad for 7 years i want to get my ex off the mortgage when we bought it i put down £85000 he put down nothing the house now has £40000 equity so has gone down our mortgage was a tennants in common not standard couple one i own i higher percentage than him 67%/33%. seen a solisitor she said he can make me sell and ask for his percentage but dont know if i can fight that as it should be of any financial gain after date of purchase not whole amount if that makes sence0

The Shelter website has a section on relationship breakdowns, including an overview of joint ownership rights and responsibilities. They also have a section on how to prevent and deal with mortgage arrears and repossession. Your solicitor should be advising you on the legal side and any settlements due. As far as i know (and I'm not an expert in this area) you may be able to get an occupation order to remain in the property and your partner can only force the sale if he gets a court order. See what Shelter say about your options.

But did your children stop needing to be financially supported 7 years ago as well? Child support is not paying for the right to see your children, it's assisting the PWC with ensuring that the children's needs are met. Should he wish not to see his children, then unfortunately, that is his sad choice. He is still financially responsible for them though, just as much as you are.0 -

I get the impression from the Child Support forum that some non resident parents are extremely adept at flying under the radar to evade their responsibilities. Has the legislation that's been introduced to trace absent parents been no use to you? Have they not commenced a liability order?
