Seller refunded full amount by accident, what are their rights?

Hi

A seller has "accidentally" refunded me £54.47, when they only mean to refund £4.99 postage.

They are now messaging asking for £49.48 back. Can they legally enforce me to pay it back? Or is it their own silly fault for refunding it all in the first place? How do ebay see this?

What am I best doing?

    In an opposite situation, I have just paid more than I should have in a paypal transaction (I was invoiced in £ for a price set in $ and didn't notice until the transaction had gone through.

    I am relying on the honesty of the seller to refund the difference or I will be disappointed and reflect this in my feedback.

    Technically, your seller may not be able to enforce the refund, but I hope that, ethically, you would do the right thing.

    Same thoughts here, it seems rather obvious to me. The OP clearly states that the extra repayment was a mistake, so I cannot see why the question even needs be asked, just send back the extra amount.

    They are legally entitled to be paid, and could theoretically take you to court for the money. Just give them their money!

    Are you seriously saying that you would be happy to defraud this person if you believed that you could get away with it?

    You do realise that there is a difference between legitimately saving money and theft?

    I have accidentally done this before. The buyer had your unfortunate attitude. I took them to court to regain my goods.

    If the boot was on the other foot I am sure you would sending emails to demand the money be paid back. Pay them the money due back, should not even have to ask the question.

  • Of course give the money back. Most people would give it back without even being asked by the seller.
