    This makes sense. I'm going to send a strongly worded letter and ask for proof that they sent & I received and opened emails.

    I posted off a letter a week ago (recorded delivery) to both Bank of America (and Gail Powell as suggested) but have received no reply. Since then another statement has come in charging me ANOTHER £12 for not paying off outstanding fees. I have paid off the amount for goods bought but am refusing to pay their late fees and extra charges because they say they sent me emails which I definitely didn't get . I'm now getting sick with worry if this continues month after month could they end up taking me to Court? Please help!

    They could eventually take you to court but that's extremely unlikely.

    The process is:

    After three to six months of non payment the account defaults and is referred to a debt collection agency

    If the debt collection agency don't get contacted by you they may pass the debt to another agency, give up chasing you, or refer it to their litigation team

    If their litigation team doesn't hear back from you for four to eight weeks they will consider court action.

    It's normally a year between stopping paying and a summons actually arriving but remember in the mean time your credit rating will be progressively getting trashed.

    You certainly have an argument re: not paying late charges given they haven't replied to your written correspondence.

    I would recommend you pay, it will trash your credit file. You signed up to paperless statements in emails received from them, so they know they have the correct email address, no leg to stand on! Sorry and good luck

    I understand that banks have up to 5 working days to log complaints from the date it is recieved, up to 56 days to provide a formal response.

    I would say it is unlikely that your letter got to Customer Advocates Office before Monday 7th Feb. You will probabally recieve a holding letter by Tuesday/Wednesday next week.

    Most banks do not default/charge off accounts until they reach delinquency of up to 6 months. You may get calls from agents trying to collect the debt.

    After another waste of time trying to get to the bottom of this mess at 28 minutes on the phone I eventually get cut off. What's the bloody point. I hate to admit it but.... THEY'VE WON !!! I've just paid the sodding charges because I can't be bothered with the stress of trying to get someone to help me.

    I absolutely hate call centres with a vengeance and that's the last time I EVER take out another credit card - good deal or no good deal !! Sorry Martin I know some of the offers are good but when it causes this hassle it's simply not worth a £10 Marks & Spencer voucher!:(
  • Had MBNA card for 11 years, no serious problems. Did manage to get some kind of late charge back once, I think, and didn't succeed another time, but generally I never go late as there's a good long period to pay on them unlike some other cards. My latest statement was issued 23 June and has till 13 July for the payment to reach them. I usually pay over the internet.
