Help please - rent arrears, how to get tenant out?

    As for a tenancy reference, you should not lie. You could simply return it stating "yes this person is currently at my property and has been since x (date)" and leave it at that.

    She has obviously applied for housing with a HA and they have written for a reference before they make her application live. This doesn't mean she will be housed anytime soon as the lists are very, very long. She is likely to be suspended from the list for former rent arrears, until she is seen to be making repayments.

    As others have said get your brother to replace the items he is responsible for with second hand goods.

    I would be completely honest and factual with the reference, advise of how long tenant has been there and the amount of arrears. Do not get into anything else as this will make your brother look bad.

    She's already given (through her brothers email?) to say the T could replace them and then take it of rent due. I'd try to retract that offer, and quickly, not sure how far you'll get though as you've most likely !!!!ed off the housing advisor.

    I agree about retracting that offer as it could be taken and probably will by the tenant that he has accepted liability for all the items the tenant says have been damaged.

    If this is the way it has been taken there will be no rent arrears as not only will the cooker and fridge be expensive models but so will the computer.

    The sooner a s21 is served and this tenant is out the better, the only question will be how messy it gets and how much damage their is to the property.
  • Well, update is that the tenant has (via the Hosuing Centre) written to my brother to fully retract the allegation of damage to items and described it as a 'misunderstanding due to lack of electrical knowledge'. Whatever that is supposed to mean!

    Anyway, he has found a local long established and reputable law firm who issue S8's and S21's without paying upfront and who allow you to pay monthly so they have been issued within the past hour, I'm told.

    He was factual on the reference request too.

    We'll see what the legal stuff does from now on then! Thanks for all the useful advice. :)

    Maybe someone had switched them off at the socket and the tenant did not realise or something? Or they had fused a circuit and did not know how to correct it?

  • The tenant is a drunkard so anything could have happened. Probably tried to make chips at 1am and turned the fridge on

    It probably means a fuse or plug needed changing, or the T had not turned the right switches on. It could even mean the T didn't know s/he had to pay for the leccy.........;)
