If I'm redundant what benefits will I get

    I am currently on fixed term contract ending at the end of March, back in December my work brought out a scheme which enabled you to leave and get minimum 3 months salary to leave at the end of December, i applied for this but then turned it down as my managers/boss was trying to get me to stay and confirmed that if i stayed till my contract ended - March i would be getting 3 months more work and 2 months redundancy at the end of it (i have been working here for 2 year 9 months so a months salary for every completed year). After considering it all, i decided to stay as like my manager said 3 more months work and 2 months redundancy so i would still get some redundancy at the end of it.
    Now it is coming to the end of my contract and they will be giving me notice at the end of Feb, i got told on Friday that i wouldnt be getting any redundancy now. Surely they cant do this as, before they said i was gettng it and that influenced my decision not to take the scheme back in Dec? Not sure where i stand on this, as i understand i was on fixed term but to be told i am getting it and i plan my life/career around it and now to be told im not only 2 months before i am due to finish is unfair plus i would have took the scheme in Dec if i knew i was going to end up with nothing.
    Some people have said about looking at the dismissal processes etc and talking to Citizens advice?
    ANy help would be appreciated.

  • Have a look at entitledto.com afaik yours wifes salary will almost certainly preclude any means tested JSA, so savings will not come into it. You may get a percentage of your council tax paid if you apply, I believe that is dependent of savings, be careful of deprivation of capital because you will be treated as if you still have the money. You will get 128 per fortnight for 6 months as long as you have paid enough NI, you sign on every 2 weeks and follow your job seekers agreement.

    I would say unless you have it in writing then you have no leg to stand on. It was verbally given, and with redundancy, never take anything on the verbal.

    Citizens may see it different, but I would not rely on it.

    How they can claim a redundancy payment is "savings" is beyond me.

    "They" don't-they claim it is 'capital', which it is; however most people say 'savings' to mean all capital, though capital can include money in a current account too, though many people would not call that 'savings' either.

    This is correct, however, IF you have not been made redundant before, and you have debts, it's only natural to pay off your debt; especially if you have no insurance protection !!

    It's then for them to prove you made yourself skint. Plead ignorance, did not realise etc. Just remember, the benifits system is not what it was. If you have money, have not cleared your debt, they will say - so what, you have suffciant funds to support yourself.

    By paying your debt, and you are under £16k savings, you should get benefits.

    Not a good idea at all! this is very bad advice, IMO.

    If you spend capital the Decision maker has to decide if you have deprived yourself of capital with the significant purpose of getting benefit, or more benefit than would otherwise be payable. They will take into account whether a debt is immediately repayable, and will ask how you planned to support yourself after spending the money.

    You will not get a 'sanction'; but you may be disallowed benefit if the DM decides you should be treated as still having the capital.

    (And ignorance of the law has never been an acceptable excuse)

    Although I agree, what makes me laugh is when a JS employee came to our company, they actually told us not to declare savings, keep quite and that what I wrote would be ok!

    Now it may not seem right, but paying back your mortgage and ensuring I have a roof over your families head, is more important than the state taking more of your money and giving me little back. Especially when we give it to others who have paid nothing in and get everything.
