DFS approved credit without my knowldge and won't cancel

about 3 weeks ago i went to DFS in slough with my cousin who wants to buy sofa, my cousin chose sofa and order on 4 year interest free credit with £100 paid advance .

2 days later my cousin recived call from them and they said bank have refused to approve credit for her but if she bring any guarantor whose credit history is good then she can have it.


my cousin called me and ask me if i can become guarantor which i don't mind as long as credit is on her name, then i got call from DFS who confirmed me that credit will be on my cousin name and monthly installment will from her account, but if she ever stoped paying to them then they will take money from me so i agreed. they took my personal, job and bank detail. then for week i didn't hear from them nor my cousin so we called to them and they said credit is approved but on my name and monthly payment will go from my bank..i was angry and told them what they told me about me being guarantor. they applogise but i ask them to cancel the order as i'm not happy about all this thing but they are not canceling. I havn't sign any paper at all but my cousin did when she went for first time and that credit wasn't approved.

Now every time i call them they said they will call me back as the manager is busy blah blah but they never call back, Can any body advice me how to deal and what are my rights plus will this affect my credit rating ?

  • If you have not signed anything then you should be ok.

    Did you give them your bank details? If so cancel the direct debit if its been setup but only if you are sure you did not sign anything!

    Yes i haven't sign any kind of paper but they said sofa will arrive in 8 weeks time which we don't even want now. we will not accept any kind of delivery but will this have any affect on my credit history?
  • I would have thought that as a guarantor for a credit agreement, then you or someone acting on your behalf is required to sign the credit agreement in order to make it legally binding (Consumer Credit Act 1974). [Anyone able to confirm if this is correct?] They would then be obliged to provide you with a copy of the agreement (if I have read it correctly - sections 105-107)

    If you did sign anything then you need to carefully read what was signed, from what you said it sound like they just switched payment details (would sound less than above board).

    If you did not sign anything, I would probably start by writing a letter and sending it recorded delivery. In this I would clearly state the facts:-
    - Your cousin applied for an item on credit & was declined
    - You offered to be a guarantor, in the event that there was a default on the payments
    - You received a verbal confirmation that your details have been incorrectly listed as the primary payment.
    - Any attempt to collect payment using those details would be considered to be unauthorised and reported to the bank as such.

    State that if they believe they have a credit agreement with your signature on, that they forward a copy to you.

    I would not sign the letter and simply print the name instead.

    If someone else doesn't come along with any other response, it might be worth asking in one of the loan/credit forums where the folks have some better working knowledge of the requirements for a guarantor or security.
