Insurance:Car Owner Deceased Moving car before probate
Hi Just a confirmation really, family member died in hospital a few days ago. His car parked in a permitted parking zone, small damage occurred to bonnet. We would like it moved to a safe place.
Any Insurance must be invalid due to owner unable to give permission for use. Intending to move vehicle to off road location. That must be about it I guess. Nobody can legally drive the car until it has been transferred to a legitimate registered keeper, which can only be after probate. Am I right?

Speak to his insurance to see if his cover is in place and drive it on yours.0

Yes the car has a certificate covering the period, but the insured is now deceased. My cover will only allow to drive anothers car, with the express owners permission, but the owners permission has to be voided upon his death.

The decease's insurance company probably won't speak to you without you sending them a copy of the death certificate.0

They did speak and as there were no additional named drivers on the policy they said the policy is now void and would officially cancel it upon receipt of copy of death certificate. Had there been named drivers then the policy would still have been in force.
Will contact my own insurance and see if they would accept my word for it that I would have had permission.

Just a though, upon death ownership would pass to the estate and I’d have thought the executors could give the required permission just as they can sell/repair/scrap etc the car before probate.
I’d watch out that your DOC isn’t one of the ones that requires the other vehicle to be insured in its own right as I’m less sure about what happens to the deceased’s policy on death, I think it ends.
If your DOC cover doesn’t require the other car to be insured then I don’t think you have anything to worry about.0 -

Theft cover (or not) is a question for the executors, I though the OP was about moving it to a safe place without coming a cropper by driving without RTA insurance0

An alternative is to see if a garage / company will move the car on a flat bed truck/van (towing could cause insurance problems - I'm no expert though)
