Not suggesting he's broken auto trader rules.

I don't think Autotrader gives a toss. It is full of scam adverts but they choose to do nothing about it.

To be fair, each time I've reported a scam advert they've removed it pretty promptly

From all we've read, the advert in question doesn't seem to be a scam at all!

I would suggest that if the dealer declared the car as Cat D Recorded in his advert, then he has declared the matter.

There is little that the OP can do about it.

I don't think just stating it in the advert is full disclosure.

What if the OP had walked up to the forecourt without looking at any adverts beforehand? I often do this when I'm looking for a second hand car. I would expect the dealer to tell me before any money is put down as per the law.

But they didn't, they read the advert.

Thats not the point though. How does the dealer know that a potential purchaser has read his adverts before coming to the forecourt? Using adverts as the sole means to disclose that a car is a write off is not acceptable.

The dealer should do everything within their power to disclose the fact that its write off before the point of sale, this includes verbally telling them even if the purchaser does not specifically ask the question.

    .

It would no doubt be acceptable if challenged, the dealer has disclosed the fact, he can substantiate this.

Update - I spoke to consumer direct this morning and they appear to be of the same opinion as me that "cat d" does not clearly indicate the vehicle has been written off.

Anyway, they've referred it to Trading Standards for investigation.

P.S. I didn't change my mind. If I had known it was an insurance write-off I would not have driven all that way to look at the car and wasted my Saturday evening let alone put a deposit down.
