    Dear Daisy, i was so sorry to read this thread, big hug. Yep, just when you think you've managed to sort something - BAM!

    Charco you are a star,people like us really need you're calm,sensible advice& experience. Agree wholeheartedly

    all is not lost Daisy,don't give up hope. i understand only too well how worn out you must be both physically & mentally. I am and I can't sleep - although I am sitting with a brandy and lemonade, maybe that will help, lol - I've had this bottle of brandy about 3 years!!

    any judge you appear in front of with see how hard you are trying to sort things out, I do so hope so and that they won't be annoyed that the secured loan have had more payments than the Northern Rock - but they were so heavy on us I felt we had no choice :(cling on to that! what a good job you did the IVA when you did! it may well give you protection,it shows how committed you are to getting straight.I am and I thought we were

    Thank God for this forum! how on earth would we cope with all this,being out of our depth without it!!

    take care of yourself as best you can. i totally know how the not sleeping is! when we get through these IVA'S these experiences will keep us that way! it's very hard,things can only get better

    Well Court date received this morning for 3rd March. Tonight I feel like crawling into a corner and quite literally giving up :(

    I am sick of fighting. Thought the IVA being approved was a huge step forward but now this....

    Got all the Court Forms but the thought of filling in all the awful things that have happened to us makes me feel even worse. When I put it down for the IVA I thought that would be it but now I have to go and have my private life splashed about in front of a judge at my local court!! Am too depressed and thoroughly down and low.

    Fed fed fed fed fed up of trying so hard to take positive steps to sort out debt problems.

  • Hi Daisy. a judge can be very fair when he see's someone is trying as hard as you guy's.

    fill your forms out,be totally honest,he will listen to you.

    you're probably worn out,physically and mentally with it all.i hope you'll go and see your DR.

    i think all of this can leave us feeling very bare. you are doing well even though you don't feel it.
    get a nice cuppa & get on with those forms now. you're a strong person, you'll get there,

    Well,

    Yesterday we had a meeting with the Mortgage Arrears Specialist at our local council who was absolutely a God send and so very helpful.

    The chap is taking our case on (free with it being through the council - although I guess it's covered in our income tax and council tax?) and is going to The Rock to see if we can get an arrangement in place before we even go to Court.

    He made me feel a lot better after 2 hours in a meeting with him and it felt great to have someone so clearly on our sides who is so familiar with the Courts, the judges and the proceedings (although he did tell us our judge is a real old stickler that even the financial agencies hate :doh:- just our luck!!)

    After going thoroughly through all the whys and wherefores he said "Well, there's certainly no recklessness here" which made me feel a lot better that he realised this has all been circumstantial and not because we've been living the high life.

    He's almost certain our case will be seen as pretty cut and dried, especially with the IVA now being in place and includes the arrears contribution of £40.00.

    He was also interested to see, that with the exception of November we have actually paid more than the Contractual Monthly Payment!! Something he says we will raise before the judge.

    So fingers crossed......

    Better go and get ready for work now but just wanted to update you all that have been so helpful and kind in your replies.

  • Hey Daisy, well that sounds a bit more positive doesn't it? that's fantastic that you have the specialist support,that will help settle you a bit.

    i really think this will work out especially as you're a bit ahead on those payments-well done you!

    whatever you do don't think of foggys message or you'll be giggling and that won't go down well will it??

    Contact your IP immediately. Explain the situation and that you would like to put the IVA on hold... a payment holiday until your hubby can find a new job!
    It's not unreasonable and provided your IP believes in you he should bend over backwards to help you.

    Also, discuss with your IP (and your new friend at the council) what your options might be... find out now because you're going to want to know if you should be cutting back on all expenses and trying to make your mortgage payments.
