Nightmare landlord

  • i wish it was as simple as that-without a landlord reference i cant get another house!believe me ive tried.our lha waiting list is 3 yrs and the only other option is a hostel-not ideal with 5 kids.

    Hi I had the same thing, I did manage to move through estate agent
    I gave them the only details I had which was a phone number
    and they too couldnt get through... my new LL accepted me with a guarentor and no landlords reference.

    I had no heating/water and my front door was falling into my house
    plus bath was almost going through top floor to below:eek:

    I moved.. job done

    HI ALL,BEEN LIVING IN PROPERTY FOR 19MTHS,HAD VERY LIMITED HEATING AND WATER FOR THE WHOLE TIME AND DESPITE LANDLORD SENDING 6 IN TOTAL DODGY PLUMMERS STILL NO HEATING AS WELL AS A HUGE LIST OF OTHER ESSENTIAL REPAIRSINCLUDING A GAS SAFETY CERTIFICATE SINCE MAY 2010 HE WILL NOT FIX,I HAVE NO CONTACT DETAILS FOR THE LL OR AN ADDRESS-TURNS OUT HE LIVES IN SPAIN AND COMES TO THE UK EVERY MONTH TO COLLECT THE RENTTHE TENANCY AGREEMENT WAS DRAWN UP BY A LETTING AGENT BUT THEY CLAIM THEY HAVE NO CONTACT DETAILS AND THEY DONT MANAGE THE PROPEERTY.GOT LHA INVOLVED IN NOVEMBER WHO ORDERED HIM TO REPLACE THE BOILER AND DO OTHER WORK-HE GOT ANOTHER DODGY PLUMMER TO REPLACE THE BOILER WHICH WAS FITTED INCORRECTLY AND DOESNT WORK AT ALL.TOLD HIM I WOULDNT PAY MY £1000PM RENT TILL HE FIXED ITAND HE GAVE ME A SECTION 21-WITH A FALSE UK ADDRESS ON IT.LOCAL LHA CANT TRACE HIM TO SERVE A HARRASSMENT NOTICE ON HIM AS HE HASNT CAME TO MY HOME SINCE SERVING THE NOTICE-HE HAS NOW HIRED SOME LOCAL HEAVIES TO EVICT ME,NEED SOME GOOD ADVICE ON WHERE I STAND.:cool: WOULD THE NOTICE BE LEGAL WITHOUT A VALID UK ADDRESS ON IT?

  • The letting agent claims that because they were only ever used to find and draw up the agreement they dont need to be involved.i was led to believe that they would be managing the property not the landloed.
  • I did get some good advice in september-since then i have been in constant contact with the lha and the tenants association who told me not to move or they wouldnt be able to help me any further as i would be making myself homeless despite being harrassed to leave by the landlord.the main problem i have is actually contacting the landlord to try and sort out the problems.

    Not getting paid rent should focus the LLs mind..?

    I would normally strongly advice against such a course of action, but it might be a valid point.

  • You say you have been in contact with your local HA . They have ordered him to replace the boiler and carry out other works so it sounds like environmental health may have issued an improvement notice (which he must comply with or face possible prosecution) . The thing is , from what you have said , the HA ought to be doing more for you . You appear to be a single person with 5 children who is being harassed by the LL or others acting on his behalf. leaving a property under these conditions should not be deemed as making your self intentionally homeless and therefore not eligible for the full housing duty.

    You need proper legal advice and you need it now. You may be eligible for Legal Help/Legal Aid because if the harassment is as bad as you say it is you may need an injunction to stop LL unlawfully evicting you

    I suggest you contact Community Legal Services and ask to be put in touch with someone who may be able to help you

  • I still think she needs qualified advice re her situation and in particular to assist her dealing with the LHA because they don't seem to be doing all that they should given that she appears to be fleeing violence and is a priority because of her children.

    Of course I don't know where she is living but I can say that of the basis of what she has disclosed my LHA would have offered her temp accommodation and prioritised her housing application. Maybe not ideal , having to live in temp while you wait for Ha or Local authority home but surely a lot better than living in fear
