TUPE if it applies means they should transfer his employment to the new contractor on the same T&C's.
As for conflicts is anyone on the HA involved with other companies perhaps a director or shareholder.
Might even be a simple as mates down the pub back handers.0 -
wow...that's very interesting about the TUPE!!! He wasn't offered the choice of any other job, or a job with the new contractor, just told he was being made redundant! But a couple of weeks later he was told a contractor was going to do his job and the contractor actually starts work two weeks before he finishes!!!! As for the conflicts of interest, hmmm...I will be looking a bit closer at that one...thanks for pointing that out!0

This would not be a true redundancy if they are bringing in another person to do his job. If he was made redundant from one company and the new company is now doing the role he can go to the new company and tell them it is his job and that it was the only job he had. TUPE would therefore apply.
It gets a little grey when it is only part of someones job. Even then he should have been involved in discussions to transfer to the new providers. A requirement by law.0 -

Last 3 days have taken my petition around my estate and at least 10 people said they had thought about doing a petition but wasn't sure how to go about it, out of over 100 flats over 80 have signed and are extremely angry and the others were out! So up to now I have a 100% support...what a result!!! One of the neighbours have even given up their time to come round with me, my local councilor has given me advice on petitioning, and i'm just waiting for our local police to provide me with a statement of support. My caretaker dosen't just lose his job of 22 years but also his home, the elderly people who I saw were telling me what he'd done for them over the years and some of them were in tears, he's done far far more than he should have done and all unpaid, we all know we aren't going to get that with a contractor, theres even notices on the doors where the older people live that advises them to contact him in an emergency, who they going to contact now???? Thanks to all of you again for your advice, if your interested or not, I will tell you the outcome in a few weeks time. x

From your response OP, it seems that the type of work being conducted by the caretaker fits perfectly with the "big society" agenda being banded around at the moment. Perhaps you could contact your local Conservative MP and ask them why the "big society" work at the grass roots is being destroyed in favour of a faceless contractor.
Also how about starting an online petition. There are lots of free ones around. I'd definitely sign it.
