Car crash thoughts?

Hi,

Firstly no one was hurt and it is only two lumps of metal so no massive deal....

I joined a 4 exit roundabout in the left lane to go straight ahead to the second exit. A car also joined in the right lane tried to overtake me, cut me, up and took the first exit left. Scraping his passanger door and rear wing down my front driver side wheel arch.

No one stopped except us he maintains I hit him.

Any thoughts on how the damage might prove the truth or will this be another case of 50/50 due to no wittnesses. :-(

    What an utter nob!

Unfortunately with no witnesses it's your word against his and the insurance companies are too lazy to persue matters too far. :(

You might argue that the position of the damage suggests you'd have to of been blind to hit him, but that's about all you can do without witnesses.

Cheers. This is the second minor bump I have had, last one was in 2003.

The first one there was a wittness who gave a statement to the police and spoke to me telling me not to worry it wasn't my fault. When it came to the insurance claim the insurer wrote to the witness who didn't respond. Now for the brilliant part in Scotland where the accident happened the police were unable to release the witness statement to the insurance company without the witnesses authority. What a stupid law!! So it got settled 50/50

With insurance getting stupid as it is I dread to think what my next premium will be with a 50/50 settlement :-(

Anyone got any ideas how much this could affect my inurance policy? The plicy has protected no claims but I am just a named driver as it is my OHs car :-(
  • i get this a lot

what you need to do is mirrors, no signal, block before they do it

or relax and slow down and let them get on there way

    Check the road markings...

    http://maps.google.co.uk/maps?hl=en&q=birmingham&ie=UTF8&hq=&hnear=Birmingham,+West+Midlands,+United+Kingdom&ll=52.492479,-1.889184&spn=0.000972,0.002854&t=h&z=19

On that section the left hand lane goes left, the middle goes left OR straight on and the right goes right....... You would not believe how many people try to go straight on from the left hand lane straight into the side of my car!!!!!!!!

So I would advise checking the road markings (take photo's) on the area where your accident occured and also for future reference NEVER assume that you can go straight on from the left hand lane.

I know this can be the case but I use this roundabout every day of my life.

There are no arrow road markings but the lane markings go from the left hand lane to straight ahead. I have never ever seen anyone take the first left from the right hand lane and I would expect that unless the left lane was marked left only very clearly then I am not in the wrong at all!!

I also doubt there are many if any 4 exit two lane roundabouts where the left and right lanes go first left?!?!?

I was a named driver on my husband's policy and had a claim (car was written off). We also had protected no-claims and it didn't make any difference when we renewed. This was back in 1998 but wouldn't have thought it will have changed. Hopefully someone involved with insurance will come along and confirm it.

sorry but I am still struggling with this from the OP

I mean no wittnesses to the accident stopped. When I asked why he cut me up he said I pulled into his lane and hit him. The fact is without witnesses he can claim what ever he wants.
  • not if you back yourdelf up with photo's of the roundabout.

plus his statement could mean alot in his down fall if he says he was in right hand lane going straight ahead.

the roundabout should have a sign post for exits and wich lane to use some do some dont but on big roundabouts most do have a lane guide.
