I imagine the postman uses the letterbox on the front door, and doesnt open the side gates and attempt to enter the house via the utility room tbh....

The land goes all around our house, the postman uses a letter box on the gate, so doesnt come near our house, but my dogs where used to the postman and the van he/she came in so where friendly towards them.

What is so annoying is my 2 dogs i mentioned have died since this happened :( one 6 weeks later due to poisoning and the other 18 months later :(

They have never bit anyone before and where just like 2 big teddy bears, one of them only bit as he was walking in to my house and i guess he was protecting me as i was in the kitchen, which i hope any dog would do if someone walked in to my house again.

  • Is it true he only has 3 years to claim?

So if he doesnt take me to court by May then nothing can be taken further?

I am not on his side, but what if he was illiterate or children after a football? A solicitor might go down that road.

I was involved in a head on smash a few years ago in a country lane I stopped but the car driver kept on coming like she was on a brands hatch circuit, her solicitors sent me all sorts of threatening mail it wasn't until we told them and the witnesess 7 me that her car looped the loop and apart from nearly taking my head off landed upside down on the hedge and my vehicle eventually the police said that if i had collided with her I would have knocked her backwards not made her loop the loop. trying to get my point to you from both Perspectives.

The is a model flying club at the end of the field next to our house, which FIL owns the field, i have been down and spoke to this man who runs it and said he is not allowed on the land to collect fallen model aeroplanes without first asking (so either we collect it or they do depending on the crop) in which i gave him my mobile number, he never rang my mobile just turned up to my house, and then the above happened.

So why don't you speak to your FIL and stop them using the field until this is sorted out?

To be fair, illiterates aren't retards. Surely they'd know it isn't their house and should not try entering the land without knocking on the front door first?

And children should know better than to tresspass. I did when I was young. When I was 5 I was too paranoid to go into my neighbour's back garden for my ball even when they had said "if it ever goes over the fence, feel free to get it back" but I always checked, just to be sure.

Since you are bankrupt there would be little point in him suing you anyway. A successful judgment would not get him any money if there are no assets to pay him with.

My dogs had been around children, aside from getting a little giddy (rottie) they had no bother with children, my GSD just used to walk at the side of children or sit next to the as if he was there to look after them, no agression at any point.

The field the flying club use is next to FIL field, owned by a company so can not stop them using it unfortunately.

As for someone to get a ball from our garden WOW they must be a pretty good kicker.
    1. they would have to be trespassing on the field to one side of our house.
    2. kicked it over 3 barns.
    3. kicked it through a set of woods.
    4. kicked it from an industrial estate past my paddock to my house

I live on a non working farm so there is land all around my house, but fencing securing it in.

Well, you have 4 signs on the gate saying "dogs running free", and the man still trespassed. First of all, he is not allowed to enter your property without your consent, so by entering he broke the law. And second, he ignored the signs that warned him about the dogs, so he consciously took the risk to get bitten by the dogs.

The 6k he is asking your FIL, is he justifying that amount?
He is trying to take advantage of the situation and scare you and your FIL to get some money.

    Don't let it happen.
