Unisured Foreign Driver hit our car!

Hello all,



5 days ago my wife & I were hit by a vehicle on the motorway which was being driven by a driver from Lithuania. After stopping and speaking to the driver for his insurance details etc he spoke very little English and so I decided to call for the Police to attend and get this information from him. The Police attended the incident and eventually got his details from him. My wife has an injured shoulder /back and the car has siginificant damage to it. My wife's insurance company have spoken to the foreign driver's insurance company and they are not willing to pick up the damage costs because although the driver is insured with them he is not insured to drive the vehicle which he was driving at the time!


My wife will now have to claim from her own insurance company for something that was totally not her fault as a result of an illegal foreign driver! Can we claim from the MIB (central insurance claim pool)? Will she lose her No-claims bonus? Where do we stand?

    If the MIB take on the claim it will take a while but will not affect your no claims bonus, get your insurance company to contact them.

    You'll lose your NCB until the MIB get around to handling your claim. Make sure you keep records of every renewal and every NCB statement so that you can at least attempt to get it reinstated when the MIB eventually sort it.

    Not saying you'll be able to mind.

    It sucks but there's really nothing you can do about it. It's bad enough when dealing with an uninsured driver from the UK.

    As thge police attended have you adviused them that the driver was not insured? If not do this immediately as they may be able to pick him up if the have a UK contact address for him.

    And for that matter pillocks who hit stationary cars and then drive off, thats twice its happened to me now my only crime being parked legally.

    There doesn't seem to be enough down to stop foreign drivers breaking the law or in fact chasing some even when legal for fines

    The problem of uninsured cars from Eastern Europe driving around London is getting worse every month, some bright spark has even started selling these foreign registed cars to the local residents in East London, since they where getting caught on ANPR when driving in UK registered cars they now buy cars from other EU countries and drive around with impunity.

    I sympathise with the OP, but I have seen several accidents involving our EE cousins, the Police aren't happy about it, but I don't think there is much they can do about it at the moment.

    Some residents in Council Houses and brand new Housing Association properties in Beckton (and other East London boroughs) have been driving their foreign registered cars for 2 or 3 years and haven't registered them in the UK yet, I think the loop hole may be driving the car over to Europe a couple of times a year, though the fact that they have their children in local scholls are treated by local GP's and have access to social housing would tend to indicate to me that they are in fact permanent residents, oh I just love the EU.

    The MIB is an "Insurer of Last Resort" eg if the OP has comprehensive cover they need to claim off their own policy. If they're not comp covered they can claim for the repairs from the MIB (Assuming the third party was at fault).

    The OP can claim her uninsured losses such as injuries from the MIB

    Good point, for some reason I had it in my head that the OP was using 3rd party cover.

    I guess these days, if you live in an area with a high number of uninsured drivers, 3rd party would be better for building up NCB? Just keep some cash in the bank to buy a second old banger.
