2nd hand car cost £7500 and is now broken. What are my rights?

I bought an 07 plate Megane Scenic from Benfield Renault in August last year. It had the usual full service/MOT before I bought it but after a month or so things started to go wrong.

Firstly, it told me a service was due despite the day before it saying it had over 13500 miles til the next one. I took it back and it was supposedly fixed. There was also a strong smell of fuel on startup but it soon disappeared. I did inform them when it went in for the first problem but the guy chuckled and said "one thing at a time mate".

Not long after that there was a loud crunching noise coming from the front of the car (drivers side). My other half is pregnant so all my spare time has literally spent on decorating on my days off and then I was feeling completely run down all thru December and was actually off work for a few weeks so couldn't get back to the dealership!

I've now recovered and took it ack last Wednesday. The fuel leak off pipe has split and is leaking fuel on to the starter motor and 2 anti roll bar bushes (?) need replacing! They quoted me £750 for the job but as I explained I had only owned the car for a short period of time they verbally agreed with the sales department that it would be fixed free of charge due to the length of time I had owned it and also considering my predicament (which I'm assuming is the impending arrival of my first child and needing a car to take my girlfriend to hospital when the time comes).

They said that the work would be completed by Saturday so I arranged to finish work early with my boss and that they would keep me informed but so far I've rang them 4 times and they didn't ring me at all except for a few "fob off" excuses when I rang them as to why the work hadn't been started.

Today I rang them for the 5th time and was told they would need to check if the work had been started and would calle back shortly. That shortly took 35 mins and then I got a call from the manager telling me that the general manager wouldn't authorise the repair costs but had come to a conclusion between themselves. They have offered to repair the car (fuel leak off pipe, anti roll bar bushes and the starter motor which I wasn't originally told would need replacing) at an internal rate (as if I worked for them) which took it down to £515 and then pay 50% of that meaning I would have to fork out the other £257.

Of course that is a nice gesture but I don't have that kind of money even more so now with a baby about 2 weeks away and especially as I was under the impression that it wasn't going to cost me anything so I would like some advice as to what to do!

(They gave me a courtesy car on the Wednesday night incase my gf went into labour) just incase anyone asks! :)

    So comprehensive cover to me sounds like no matter went wrong it was fixed for nowt? I'll have to check to see if I've still got the openroad leaflet! They said I could take the car and get it fixed elsewhere but "considering the discount", they don't think I will get it cheaper than that plus they would then want the courtesy car back and then I would have to wait for a different garage to repair it but still without a car to drive! Aaaarrrgggghh!!

  • Get in touch with CAB and Trading Standards as they will tell you the best course of action. Also read your warranty booklet to see what it covers

    Get in touch with CAB and Trading Standards as they will tell you the best course of action. Also read your warranty booklet to see what it covers

    I read the whole of your thread about your car troubles before posting this to check the likely outcome/advice and your starter motor was covered in your warranty but they're trying to charge me for a new one! No doubt each warranty is different but just found it interesting! :)

  • If you can find out who the underwriters of your warranty are with it might help you find out some more information

    Comprehensive warranty

    Every car we sell, no matter how old, comes with at least 12 months warranty. Comprehensive cover is provided on all cars less than 5 years old, unlike many who only offer a named parts warranty, even on younger vehicles.


    BUT it doesnt tell you what the warranty covers hummmmm

    This is also who Hartwell use so if you find that your cover is from Car Care Plan then your starter motor will be covered.

    That's the same address I have in the warranty book but it's called Rosesale Finance and Leasing!

    It does say pipes aren't included under the misc items but it doesn't mention anything about a starter motor!

    Not included:
    Brakes and clutch - frictional material where condition is due to wear and tear

    Continated fuel - the clearing of fuel lines, filters, carburettors and pumps.

    Electrical accessories - radio/cassette/cd units or any other component within the music system. Traffic management system, sat nav, telephone, tv and associated equipment of all types

    Misc items - tyres batteries, bulbs, water inbreed, exhaust systems, aux drive belts, ht leads, distributor cap, rotor arm, pipes, brackets, mountings and hoses!


    Is an anti roll bar bush classed as any of those on the misc items part?
