road tax fine help

hi,
my o/h part ex'd her car last august with a main dealer, it was still taxed to the end of the month.

2 weeks ago she got a letter from the dvla saying she was still liable for the penalty of £80 for it not been taxed or SORN.

she wrote back to them stating she part ex'd it in august so she wasn't the owner when it was up for renewal,
however because they never received the logbook stating this, she must still pay it, but will accept a £40 fine if paid straight away!

she told me she never got the slip usually retained by the seller to forward on to the dvla and i always thought that if a dealer bought a car off you this was common practice,
unlike selling privately (not sure on this)

but the salesman told her he'd take all the paperwork and sort everything out,
they even stored her new car has we were going on holiday the next day!
they also nearly cocked up her papers for her private plate,
not sure but that might have been why they kept everything in the first place with it been a private reg.

the manager of the dealer wont return her calls and she wont speak to the admin staff as they have tried to fob her off saying they've done everything right, though she only got a receipt this friday....nearly 5 months on?

is she still liable for the fine or should she try and force the dealer to pay,
this is not a little trader, they have a large chain!
might even refuse to wear our teams football shirts has their name is spread accross the back of it ;)

    arnold shark kept all ours when chaning our private plate from the trade in to the new one, appeal to the dvla.

    The seller of the car MUST tear off the slip themselves and have it signed by the new purchaser/ dealer.

    The seller must then post it to dvla.

    If the seller hands over the entire V5 document to the purchaser/car dealer
    they are breaking the law.

    is it the same for a dealer? he did say he'd take the lot and sort out re-plating both cars

    If you sell to a trader, as the seller you should still send of the section to the DVLA. See http://www.direct.gov.uk/en/Motoring/BuyingAndSellingAVehicle/AdviceOnBuyingAndSellingAVehicle/DG_4022403 and go to the bit about selling to a trader.

    The DVLA will then write back confirming you are no longer liable for the vehicle.

  • It clearly states on the V5 what is required of you when disposing of the car. Why do something different on the word of a motor trader ? since when have the Arthur Daley's of this world been trustworthy.

    She should have given the tear off slip to the trader/dealer and then sent the rest of the V5 to the DVLA.

    She shouldn't have trusted the dealer, it is her responsibility to inform the DVLA of the change of ownership. Pay the fine and let it be a lesson learnt.

    Rather than be a smug you should have merchant just a thought.

    When you part ex the car did they give you a nice invoice etc dated to show your car being taken as part ex, along with the reg? if so send a photocopy to the DVLA and state as of the date on the invoice the car became the responsibilty of the garage

    The DVLA won't care, all they care about is the V5. Its the sellers responsibility to ensure it is sent to the DVLA.

    Sadly, that would not be acceptable to the DVLA, they will only accept the V5 duly completed by the recorded keeper.
  • Pay the fine and then send a letter to the dealer claiming the cost of fine
