Argos free item not in stock

Hi All,
I'm not sure of my rights here.
I got an xbox 360 with Kinect for xmas, and there was an offer where you got a free games pack containing Forza 2, Halo Wars and Halo 3. This is worth £81.
It was not in stock at the time, and so we received a credit note. Now we've checked several times since and it's not back in stock as yet, and we only have another 3 weeks until the 2 month redemption ends.
One salesperson stated it may not even come back in to stock, and said we wouldnt get anything else in return as it was a 'free offer'.
Surely this cannot be right?
I'm not sure of my rights here.

Free or not, it was still part of the offer for sale and you are entitled to receive the games.
As to the salesmans statement that is was a free offer, I wonder what Argos would have done if you bought the xBox (and received the extra bits), then returned the xbox (but not the extra bits) and simply told them that they were free so you don't have to return them.
Contact the store manager, explain the problem and tell him/her that if Argos are unable to supply what they promised, then they must accept the xbox back and give you a full refund.
I'm sure that they might then find them from somewhere.0 -
They offered the items in question at a specified price, you accepted that price and they accepted the order to supply those goods. Therefore I would have thought the options are:-
- They supply the missing item(s)
- They accept all items back and give you a full refund (end of contract)
- They provide the funds to source the missing item(s) elsewhere.0 -
When you're there asking for your games, can you ask them for my free strimmer too which is OOS? Please?0

Usually these offers are "Subject to availability" did the advert say as such?
I assume that you were made aware that the free item was not available at the time of collection, at which point you could have declined the offer.My farts hospitalize small children0 -
Being someone who worked in Argos a while ago, I can tell you that it is company policy to only give you those items from the certain amount of 'free stock' each store is given. If the store gets no more 'free stock' you will not get your free items. Whoever sold you the bundle would have told you at that time that IF it comes back in stock you will get your free items, but if not you wont get them. And all of the offers in Argos are listed as Subject to availability because there are so many stores across the UK. Therefore they are not obliged to give you the free items if they dont get any more of the 'free stock' in0

What would make more sense would be for the warehouse to send the same number of game packs to each store as they sent consoles.

Not sure why, the company doesn't twist your arm to buy the product. In the same way as they are not obliged to provide the free gift (if they run out of stock) you are not obliged to buy it.

One of two choices, either keep or return. I've had this before, with a different product, and chose to keep as got it a good price.0

I'm guessing the offer isn't a permanent one, but either for the life of that catalogue, or a short term offer, in that time they may not sell all the consoles, so would order x amount of free gifts based on projected sales during the offer.
Have you tried other stores OP?0
