Yep, that is correct, but you are looking for errors of law, not errors of fact. The Tribunal are not infallible, they can make mistakes, but they are rare. You would benefit from a specialist helping with this - it is something I would struggle with, and I deal with disability law full time.

Have you every cone across any errors of law?

An appeal is a tribunal. You can have a reconsideration before an appeal.

So how come we had an appeal which was turned down, tribunal date set for April (sometime) but due to medical evidence has now been passed as in the work related group.

By the way thanks for your apology for suggesting that a terminally ill person should get a job, he actually should be in the support group but after the fight weve had I think I will just leave things as they are now!

You never said that he was terminally ill. If he was, he should've got the support group component from the start of his claim.

Exactly, so why have we had to fight and he still isnt in the group he should be. Look back and read posts 29 & 25.

Personally I have not, but there is case law where they have been found. I'll have a quick look now, but may need to get back to you on that.

Ignore her sh1305, all cp seems to want to do is distract other peoples threads (and you are, of course, correct). ;)

Here are some recent cases, you will see that some challenges are based perceived procedural irregularities, and some on the Tribunal's interpretation of the word of the law.

Shame on me for correcting you when you give out incorrect information? The reason you have to fight is because you are dealing with something that you do not understand, but you refuse to accept that you are wrong.

  • Why dont you just tell me what point you are trying to make rather than me trawl through all the cases that you have highlighted.

The cases are for Jock221, as this is his thread, and he asked me for examples.
