NHS Redundancy rules

hi, I was made redundant after 5 years at my local NHS in Scotland. I am trying to find out how long I must wait before I can apply for another job within the organisation.

I know a lot of places make you wait up to a year...if anyone has any info, it would be much appreciated.

I did check with a local nhs HR..they said something along he lines of 'the handbook is silent in terms of time frame but the 'rule of thumb' is the amount of months redundancy that you have taken"....all sounds a bit 'iffy' to me...surely if there is not something stated in the handbook, then it is not appropriate?

I dont know..any suggestions?? :)

    I understand that organisations can set their own rules and they may vary within the NHS.

    I cannot believe that any reclaim would happen five years after the event.

    Hi I don't know about scotland but in the uk if we took part in the mars redundancy scheme then we are not allowed to work for the trust within 6 months I believe. I think it's down to individual trusts.

  • If you have been made redundant (rather than taken voluntary redundancy under the MARS scheme), I wouldn't worry about it. Agenda for Change T&Cs state that you have to have a 4 week gap between NHS jobs if you have received a redundancy payment. In practice, I very much doubt that the NHS keeps track of where people go after redundancy.

    The situations a bit different if you have left under the MARS scheme. Technically, you can't rejoin for the number of months payout you got. So, if you had enough service to receive 8 months payout under the MARS scheme, you should not rejoin the NHS for 8 months or they could ask for some of the payment back. Again, in practice, I very much doubt they will keep track.

    Can anyone tell me if MARS severance payments are taxed or not?
    My Trust is likely to offer MARS again shortly and it may be suitable for me, depending on whether the payment is taxed.

    I'm pretty sure in our nhs trust it says anything over £30k is taxed

    £30k is the tax free limit for any termination compensation

    for redundancy we have been told we have to wait 28 days before being offered or accepting a job with the NHS or local authority....

    - i work for the NHS...

    I am fairly sure that 28 days period will force you onto the newish pension scheme, rather than the final salery one - which the government will probably take anyway. Suspec it will also affect your length of employment to the NHS including holidays, so you will effectively be starting as a new person. You may not be able to come back as an employee, but are able to come back as a contractor :)
