Furniture Village problems/payments

Hi,
Two separate questions:
1. We bought a sofa from furniture village a few months and when they were delivered we found that some parts of the leather were a lot wrinklier than the other parts. Most of the pieces that are stitched together are almost without wrinkles while there's two pieces of leather on one sofa and one piece of leather on the other that's very wrinkly and seems of a different quality/age/texture than the rest of the sofa.
They sent us a technician that looked at the sofa and refused to do anything. We didn't think we could do a lot and let it be.
2. In the meanwhile, I got a call from furniture village saying they had mistakenly refunded just over hundred pounds back to my CC and want it back. I told them about my problems and I haven't paid them yet.
My question is:
Can they legally ask for the payment? Isn't the refund their mistake?
Morally, I have no problems keeping the money as they haven't delivered what I paid for and refused to do anything about the problem but is this legally correct?
Can they push this further? legally or by sending the issue to an agency?
Can I just say no to paying back the money?

1 Yes they can.
2 Yes but completely irrelevant they are still entitled to it back. If you had paid someone extra by mistake what would your attitude be then ?
3 Yes and quite possibly will.

How much was your furniture ?
A cow hide has areas of very smooth stiff leather(down the back bone)and areas of very soft bumpy streachy leather( around the belly)and all sorts of leather between.
On the cheaper sofas they just cut the leather up and mix it all together,smooth nex to bumpy leather.And use all the cow hide.
On expensive furniture they use more hides and match the leather more,and sell the unused parts of the leather onwards.

I dont see why you should repay just yet.
If you genuinely believe the products to be faulty then you should withhold the £100 until the issue is resolved? Effectively you have underpaid by £100 and you can say the transaction is in dispute and until they resolve you wont be sending the final payment of the sofa.
Thats just my opinion and I rekon they will sort your issue out quicker.0 -
Also, this is not a credit agreement so they can only make a change to your credit rating by going to court and winning. If the product is faulty I am sure the judge would take this into account and therefore they most likely will not take you to court.0

They're separate issues, I'd handle them separately. You can use the evidence of your good nature if you end up taking them to court over the leather. If it's a big problem, get your own 'tecnician' (a phrase which means nothing legally - it could be the managers nephew for all you know, so you need your own independent one) and decide if you're going to court.0

I am not sure if they are separate issues. The refund is linked to the sofa in question. Therefore if I am not satisfied with the product I would not want to make the final payment until the issues are resolved (i.e. the amount refunded). FV havent completed the transaction satisfactorily so why should the OP.0
