can not claim contubution based job seeker allowance

    just to give you all a quick update,went to cab had a 10 min chat they will get back to us through the post for a meeting? ok but we need the advice now.
    went to the tax office they were very helpfull and have opened a case,gave all the info i had for 2008/9 and they asked if i could get bank statments for that year showing my pay going in as back up,done that with the bank it will take up to to 5 working days to arrive.
    went back to the job center to see someone they would not see us and said there was nothing they could do,but we could sent all info off with a letter of appeal.
    the all in one center was a lot better,we are able to have council tax benefit and a claim for dinner tickets for the kids is going through.
    but i realy dispare at the moment with the welfare system,they will not do anything until proof of 08/09 tax year is sorted,its only luck that my wife's wages cover the main bills morgage/car loan/insurance ect,but week by week we are living on £100.00 tax credits until the tax ni thing is sorted

    Good new that everything is starting to work out. The CTB people and the kid's meal people are likely to let the claims go through.

    In fairness though, the JS do have to be careful about dodgy claims (not yours I hasten to add) and must work within the rules.

    Most people (including mysef!) are lax about keeping important records likes P60s etc, and the moral is to keep these thing "just in case".

    You are legally supposed to keep payslips and P60's for a minimum of 6 years.
    If you have a scanner, then there is no reason why you can't scan in all your payslips and P60's and Tax code notifications and store them electronically by tax year.
    That way, if a benefits agency needs your last 12 weeks payslips and your mortgage PPI provider also needs them, you can simply print-off 2 copies and send 1 to each. Also reduces the amount of paperwork clogging-up the house.

    What exactly does that prove? It doesn't prove what NI you've paid.

    It proves that he was being paid though, and by that employer. HMRC want proof that he was working there and what he was being paid. It won't help his JSA claim at the moment but it will help HMRC in their investigation into why the employer was not paying what he should have to the tax man on the employees behalf; earnings on a bank statement ove a certain amount would dictate tax ought to have been paid, and if there isn't a contributions records for the OP for the same time period, I would imagine HMRC will have a few questions for the employer.
  • howgie40, i am having the same problem, my husband has been out of a job for 4 months now and we cant get a single benefit, js its because of no national insurance for 08, they dont seam to take in to account that he paid it every year before and every year since. hope you have better luck than us, atleast we dont have some kids to feed
