hello
this is my first post,i was laid off from my job in greggs the bakers on xmas eve, appied for income based job seekers, but was told today that it was declined, when i then asked about contrubution based job seekers i was told that i could not claim that because they had no record of me working 2008/9 even though i was working at the time, the firm that i was working for went bust.i phoned the tax office and they said the same no record of 2008/9 now and hear is the problem i cant find my p60 anywhere for that year and i never used to keep my pay dockets,so where do i go from here,i have my redundancy letter stating i worked for the company from sept 2006 to march 2010,i have a few aprasal letters from 2008 and a pay slip from early 2010 and a refrence from 2009 but thats all i have. the company were taken over for a while from april 2009,so i have phoned the employer that took over but they said they will get back to me,and i phoned the company who delt with the closure of the factorythey also said that they will get back to me.
but until that is sorted we have £98.00 a week tax credits to live on my wife works part time and earns £630.00 a month and that pay covers the bills,so until this is all sorted, thats all we have to live on,i also have 2 children aged 14 and 12 the eldest has dla, which will help us a bit at the moment but i just don't know what to do,this is the fist time i've been out of work since 1993.
thanks

Unless you can prove you made sufficient contributions in the qualifying years you won't get any contributory based JSA. Have you told tax credit about your change in circumstances and loss of your income? You may be able to get your tax credit award altered.
Also look into the possibility of housing benefit and council tax benefit.0 -

yes my wife has phoned the tax credits we are not entitled to anymore money because they have taken what i have earned up until now,and my wife only works 20 hrs a week so we can't have working tax credit, and the tax office said for me to take whatever info i have for the year 2008/9 down to the main office and they will open a investigation into it,i am not the only person this has happened to in my old place of work its seems the company did not pay any tax or ni for anyone for the year 2008/9.
the point is there must be something i can do to get money while all this is being sorted out?0 -
what if i get a bank statments for that year showing my pay going in i know that it does not show tax or ni but surely they can then see it i was paying it?0

it woun't but i realy don't know what to do about the situation0 -
you need to ask jobseekers allowance to raise a for HMRC to do an investigation, you will also need to submit all the letters, payslips etc that you have as evidence0

Just take your letter from the JC stating that you are not entitled to JSA to the HB people as proof of nil income.
In cases like this, HMRC will eventually deem the NICs to have been paid, but this is not something that will be done quickly. Your best bet is to find out which section of HMRC is dealing with this and chase them up."If you can bear to hear the truth you've spoken
Twisted by knaves to make a trap for fools"
