solicitors bankruptcy checks how far back??

Hi all,
Does anyone know how far back solicitors search when doing a bankruptcy search.
I was made bankrupt back 2002 and my credit file is now clear, have been accepted for a mortgage but have been warned that if my bankruptcy shows up on solicitors checks my mortgage provider may withdraw offer. I have also married since my BR so would they also do checks in maiden name?

Hi There,
Although your name comes of the insolvency register after discharge and your credit report for six years.
It is still stored forever on the london gazzette listings. I am not sure if a solicitors search covers this.

Mortgage providers have a list that they can check of former bankruptcies and most will ask the question on the forms "have you ever been BR?" Which you must answer "Yes". With the BR being discharged so long ago you probably won't have any problems as long as you have kept your credit file clean.BSCno.87The only stupid question is an unasked oneLoving life as a Kernow Hippy0

They actually check the insolvency services register in Birmingham which list all bankruptcies for the past 100 years!
So when they do a search the answer is 100 years!
On mortgages the question is often asked (Have you ever been...) be honest as that is what they are looking for. If you try and hide the bankruptcy, then this raises the question what else are you hiding!!I Also Post On Other Forums

i didnt know that either but at least now i do. 100 years means its never gone but at least we can all breathe again and not fear the phone or the post anymore.0

Nope 'cos the Gazette record it forever!!
I've actually found gazette entries when doing various bits on family history for people who were declared bankrupt back in the mid 1900's (1850's)
Once in the public domain, always in the public domain, and it will get easier to access these 'historic' records over time thanks ta t'interweb.

So does this meant then that anyone who has been made BR in the past, however long ago gets flagged up after these solicitors checks n therefore won't be granted a mortgage?0

No
The reason why mortgage companies ask about past bankruptcies is to assess the risk involved in lending money at this level (high level).
For example, they check the IS records in Birmingham, and they see that you had a criminal bankruptcy against you ..... YOU are a higher risk than someone who declared bankruptcy themselves with no issues.
Also by telling them that you are a past bankrupt it shows you are being honest with them.
If you choose to try and hide the past bankruptcy then that then begs the question, what else are you hiding, so you then become a higher risk again!!
There are MANY many past bankrupts who have gone on to get a mortgage, with little or no problems, though in the earlier days post bankruptcy you will be asked for a higher deposit and possible higher rate for a year or so.
Oh and the search is carried out on the Insolvency Services records NOT the gazettes, as the IS records wont contain mistakes!!!
