dodgy garage?

my son bought a 52 golf last november, when he looked at it the rear door wouldn't open from outside but the garage said he would fix it. when we picked it up he said that the part wasn't in stock and he would ring us when he had it. after a couple of weeks the car developed a shaking when braking again he said he wolud look at it after the snow, after the hols etc. was supposed to take it today to fix the shake, still no door part, but he rang to say that he couldn't do it beause he was too busy with other mots and ring next week to sort out new time. the car was issued with new mot at purchase can we do anything about it because i didn't think that it should pass if all doors don't open or is it too late? should we just get the work done ourselves.

    You can request a reject, repair or partial refund on the car under the SOGA.

    Google the Sales of Goods Act, or give consumer direct a call: http://www.consumerdirect.gov.uk/contact they can explain what it is you need to do. I believe you have to write an official letter rejecting the vehicle (templates on the consumer direct website), giving them 28 days to do something about it. After that it's small claims court.
  • This is an 8 year old car. The brake fault developed after sale therefore I doubt you have much recourse here. The door part is part of the sale and you should give reasonable time to fix it.

    I would write by recorded delivery advising you require the repair to be carried out ASAP requesting full completion within 14 days advising if it isnt forthcoming you will arrange repair elsewhere and invoice through the small claims court for the cost.

    Rejection under SOGA for the door in my view wouldnt be applicable nor replacement.

    That's what they told me when I went through it.

    Yes, but I don't think its reasonable to expect an 8 year old car to be totally faultless for 6 months. I mean, a head gasket failure or something then sure but just a faulty door?

    MrRedundant's advice is good.
    I'm afraid you're outside the time frame to deal with a dodgy MOT. Its 28 days, except for corrosion related issues which is 3 months.

    The car I bought was 13 years old. That's the advice they gave me, if you don't agree then take it up with Consumer Direct, as it's them that told me.

    In this case the garage has already said they would repair the door, yet they haven't. Them knowing about the fault at the time of sale doesn't stand them in good stead. The OP has a right to reject the car.

    Correct but if the fault occurred after sale and this can be shown (i.e by the fact you drove it and it didnt vibrate....) then this won't stand up.

    the door was not working at time of purchase but we were told any problems within the first month to bring it back which is what we have been trying to do, he just keeps fobbing me off when i call. not sure wheter its because i am a women and my son is 20 or its just the way he is.

    why is it a 'dodgy' garage?
    has he flatly refused to fix the car?

    cut the guy some slack he is busy(a good sign) and has to wait for parts, dont forget that the recent bad weather has screwed deliveries up for a lot of people
