Why didn't you check the dress over at the time of purchase?
  • It is still your word against theirs, I mean a snag on a dress can be caused by getting caught on a doorframe, or velcro or nail whilst out.
You can try taking them to the small claims court, but like i said its word against word.

Quite right but the advantage is with the OP as the shop has to prove there was no fault within the first six months!

Mezza, I can also see it from the shop's point of view and I don't think you can write Debenhams off as a result of them questioning you. They must have people trying it on all the time - buying something just before New Year and then taking it back just after, claiming it's unsuitable.
I am not saying you did this, but that other people do.

I once had a friend who regularly bought designer clothes and wore them (leaving the tags in) and returning them after she'd worn them. One day when we were at another friend's wedding, she went to the loo and someone said "oh dear, your label's sticking out" and she tore it off. When my friend came back from the loo and told us, I had to laugh. She was livid that she wouldn't be able to take the outfit back. It wasn't like she was short of a bob or two either. Needless to say she's not a friend any more - she ripped me off and didn't pay for services my company provided.

So you really have to see it from both sides. ;)
  • Can see this from both sides. It seems the OP is a victim of the dishonesty of others (i.e. those who do wear things once then take them back. Will be interesting to see what happens next.

    Hi everyone.

I tried it on in the store and it fit fine but it had no labels attached so when i went to the till i asked then if they had another of that dress that did have labels cause i knew that not having labels could be difcicult to return. the lady at the till said that as it was sale stock all their dresses were alreadyu out and that was the last in my soze but not to worry because if the item needed to be reyrned i just needed to keep my reciept and would be offered a exchange since the dress had more 50% off. I bought the dress thinking that it would be fine.

<snip!>. She said she could only exchange it for something else in store to which i told her was unacceptable. I already had to rush out an get another dress as it was for New years eve!. she went off and spoke to another woman who came over and said the dress looked like it had been worn. I told her it had not been worn because i had noticed the snag in the back! I told her it had only been tried on in their changing rooms (not even by me at home! ). She then went off and got the store manager who came over and told me that they could not do anything as there are no lables on the dress, the dress looks worn and the snag is not enough the deem the dress as faulty!

    Thanks, mary:(

    ???????
Why was this ok when you bought it and not ok when you took it back? The dress had no label and you had no proof of it's state when you bought it so I'd say that an exchange was probably quite generous given the timing of your purchase/return.

    It's only a game

You missed out the word 'inherent' before the fault word...a snag/catch does not fall into that category.
  • An update:
Today i recieved a written apology for the unsatisfactory customer service i recieved and a full refund of the dress.

    Happy days! :money::money::money::money:

At least Debanhams Head office know how to treat their customers. shame the same can not be said for the Swindon Store.

You should go into the store now and show them the letter to remind them!
