Alloy wheel damaged beyond repair on Tesco Car park

Evening All,

This is my first post on here, and having seen some of the brilliant posts on here, I felt this was the best place to come for advice!

I have recently visited my local Tesco store at quarter past ten in the evening. To cut a long story short, there was an enormously deep pot hole on the car park that has damaged my alloy wheel and tyre, both beyond repair.

I am currently writing a letter of complaint to tesco, stating that i require reimbursing for the damage to my wheel and tyre.

I have taken photos of the pothole and have included all the relevant quotes/details in my letter.

Do I have a case? or am I going to have to fork out over £500 for a new wheel and tyre?

Cheers,

Dan

Suggest that the photos have something included (tape measure/ruler etc...) to indicate both the size and depth of the hole. Photos without this would give no idea of the size.

How wide/deep was the hole? What speed were you doing?

  • its a better effect if you take a picture of the wheel in the pot hole

you must have been going quite quick or did the edge of it catch the edge of the rim

If you compare this with people falling on potholes or broken slabs on pavements you can only normally claim after the party concerned has been advised of the issue and they fail to resolve it. If your the 1st one to trip is unlikely your claim will succeed. I suspect the same is true for roads/car parks otherwise the last 2 winters would have bankrupt most councils.

Just how big/deep was this pothole, and how fast were you going when you drove over it?
"You were only supposed to blow the bl**dy doors off!!"
  • ive lost a few wheels to pot holes but never complained as i should have been looking where i was going

i did get pulled over by police once for driving slowly and weeving around pot holes when he asked what i was playing at i said i was driving to the current conditions to which he had no answer lol
  • I was only going very slowly as the hole is literally 2 feet in-front of a speed hump and flow plates. The edge of the hole is sheer and has cut the sidewall of the tyre and dented the wheel.

There is no way of actually going around this hole as the entrance to the car park is one-way and quite narrow... I measured the hole, and have photos of a tape measure in the hole.. it is over 4 inches deep.

    which Tesco was this?
  • You have to show neglience.

I.e Tesco knew of the pothole; didnt fix it in a reasonable time and should have fixed it before your incident. You cant hold them liable for a pothole unless they have been neglient.
