Fonehouse help!

On Saturday me and h went to fonehouse and were talking into a new phone contract.I know I know we should have said no!
Anyway, weve spoken to vodaphone direct and can get the same or a better deal for much less and with a better phone, the one we got was a samsung monte slide with 300 mins, unlimited texts and 500mb internet for £25 a month.
Anyway, we've decided we want to cancel it and find a better deal and know we have 7 days to do this. I just rang them to see when they are open until and the girl said we signed something to wave the cooling off period, We have no copy of this and were not aware we were doing this. I just know when we go in tomorrow they are going to be horrible and ask a million and one questions and then maybe even say no to cancelling it. She was a bit funny on the phone asking why we wanted to cancel it and said we should go in tomorrow when the manager is in.
If they so say can we cancel it directly through vodaphone? Argh I can see this is going to be a nightmare!!!

"Have you been into the store yet to sort this out, if not then we will investigate from this end. In order to do that we would need the following information:
* Your name
* Your postcode
* The store that you visited
* The name of the person who served you, if you remember
* What specifically is it you like about another deal that you
have seen.
There is no cooling off period with Vodafone contracts, and this is fairly standard across all retailers. The only returns period that the stores advise customers of is that you have 28 days in which to exchange your phone should it develop a fault within that period.
If you can get back to us on 0844 2571183 with this information as soon as possible we will look into this for you to get it resolved.
Rest assured we take all complaints and such unusual circumstances very seriously.
We are awaiting your call.

There is no cooling off period for in-store purchases, unless the retailer chooses to offer one. As you've apparently signed to say you acknowledge this, then I doubt you could argue otherwise. The 7 days you refer to is for distance selling.0

With vodaphone are you able to change you contract each month like some of the other companies?0 -
Depends on the contract. If it's "Your Plan" then unfortunately you can't reduce the amount.0

I've no idea, we only got one bit of paper which is an airtime order form? That's it, nothing about the dd or anything, which is making us concerned that its not legit, argh! We rang vodaphone and they said we've got 7 days to cancel but it has to be done through fonehouse, so if they say no will vodaphone do it?
It's a 24 month contract.I wish I had come on here first, what a pain, were so gullible its untrue!!0 -
Fonehouse are under no obligation to allow you to cancel the contract unless their t&c state that you can. They exist on the commission they receive from the networks and out of that, they "give you a free" phone.
Now you have changed your mind and that would leave them out of pocket with a 2nd hand phone to offload. Would you have wanted someone's cast off when you took ou the contract? I suspect not.
If Vodafone are still prepared to pay their commission to them, and then cancel your contract, then I am sure Fonehouse would have no problem. Not likely, though.
Before you go into the shop, read up on your rights under Sale of Goods Act re mobiles so that, at least, you know here you stand in law.0 -
