Hi,

i used to be a member here but cant login to my usual details for some reason anyhow i was hoping i may be able to get some advice. Less then 6 months ago i bought a htc desire from carphone warehouse simfree for 400£. Unfortuntly just over a month ago the phone developed a fault with the charger socket and had to be sent back to htc for a warranty repair. When i had my phone back the charger socket was fixed however they broke my power button.

Due to the fact ive had other issues with the repair centre in this time ie not being able to find my phone at one point , not calling me back , and taking a month longer then quoted to repair, i really dont want to have to go back to them. Ive spoken to carphone warehouse this morning as the phone is less then 6 months old and simfree network free / non contract, to try and get it swapped they have told me under no circumstance will they swap it ... the most they can do is send it to htc for repair which i have already done and has come back to me broken.

I thought in this instance the sales of goods act would cover me , i could understand if it was a contract phone but its not, anyhow any advice would be greatly appreciated .... i was thinking of going in there saterday when its busy and playing my face but obviously dont want to if im in the wrong :)

I did also try the search button but most the posts i read or found was for contracts phone :)

Sale of goods act says the retailer has to offer a repair or replacement for a faulty phone. However it's their choice. It's under 6 months so the law would assume the fault was due to manufacturing but as they are willing to repair the phone thats not a huge issue.

Unfortunatly as they are offering repairs so then they are staying within the law and you don't really have much to go on legally, but you could try appealing to the goodwill of CPW.

    Sorry it's not better news.

I'm afraid CPW haven't produced a suitable ghost. Same to you.

Your first stop should be http://www.consumerdirect.gov.uk/
They will give you good advice and have standard letters to send out, they also continue to help if these do not work.
I believe the law is that goods should be of satisfactory quality and also last a reasonable time e.g. a mobile at least a year, a washing machine at least 3 years. You have given them ample oportunity to repair now you should be able to demand replacement or refund but go by above's advice.

It pays to be obstinate but try to keep all details of correspondence, etc.

I had a problem with E2Save [CPW] and T-Mobile on a mobile dongle, because I believed TM's excuse I missed the 7 day returns date [by 1 day] with E2Save. There was no signal at my home even though their website said there was. Loads of 'its up to them not us' from both, then threats from debt collectors for not paying TM for a service they admitted they could not supply. I had saved all details, times, emails and names - sent stock letter, no action. CD got local trading standards to contact me, I gave them all info. Next day they rang TM, in the afternoon TM rang me to tell me they were sending returns envelope and I got postage back and account and debt collectors reset to zero.
