car damaged in car park

over New Year my car was parked in the car park near my house, next to a reliant robin.
the robin was rolled on its side (apparently something that has been happening since a top gear episode??!!) when i saw it, it had been rollled away from my car. then i noticed the back window had been broken. a couple of days later, i went to move my car and found that there was a dent, scratches and blue paint from the robin along the side of my car.

where do i stand in trying to get this put right by the owner?
I only have his registration plate.
My insurance werent too helpful and said it would be recorded as a non fault claim if they helped me with it so it would affect my premiums at renewal.
they suggested phoning the police to report it so i could get his contact details and follow it up that way, but I'm concerned that as I dont know exactly when it happened they will try to deny any liability???

    if it is vandals rolling the car then the other driver is not at fault either ??

    If the incident involving the Robin has been reported to the Police, they may have charged the culprits (unlikely I know) and you could then report the damage to your car as criminal damage and sue the criminals once convicted.

    Yes, but if the car was rolled away from OP car then logically the owner of the robin came back to find his robin destroyed, and either called for help or rolled it back himself, anyway, when returned up right it has obviously crashed against OP car and then the robin has been driven away.

    Check on askmid that the robin is currently insured there's a 'free check' button at the top.
    Get the Robin registered keeper details from DVLA costing only about £3
    Go and photo the Robin to see if it has your cars paint on it and the relevant damage still to support your case.

    Then claim directly from the robin's owner/insurer for repairs to your car.

    Your insurer is talking balls, they could easily go after the robin's insurer considering all the evidence and circumstances. IMHO

    UNLESS the robin is still there on it's side, then logically the damage to your car occured by the vandals rocking the robin in order to turn it over. In which case, I dunno, but I still think you might have a claim against the Robins insurers, however wrong it might seem.
  • hi, just checked and it is showing as insured.
    I didnt think at the time to photgraph both cars parked next to each other :o and the damage, but i will have a look. will also go down the dvla route if thats the best way to get his insurance details- can that be done online and should i still contact the police??
  • i wasnt sure if it had been rolled again or whether the owner caused the damage righting the car- but i suspected the latter.

    You don't get their insurers details, from DVLA, you can do that in two ways either online through askmid pay a small fee or by sending your claim for damages (also ask him for his insurers details) to the Robins RK, he will pass on your claim to his insurers and they will inturn contact you.

    Apologies op considering the damage to your car, but I can't get the image out of my head of the Robin owner, when he came back to his "car". :rotfl::rotfl::rotfl:

  • it is still in the car park, but our cars are parked in different places now :(

    I now have his insurers details so I will get in touch with them.
    I have also been out and taken some pics of my poor lil car, and the roofline of his- its not in the best nick overall, but there is a clear line along the edge where the paint is gone now...

    so- should i still contact the police?

    sorry, but I dont agree that it was ever funny :(

    When i saw it on its side (and didnt know about my car) it was upsetting to think somebody would damage another persons car like that for no good reason, though it seems the people who did it thought it was funny as well. if it had been your reliant, would you have been laughing at the joke?? I imagine he was horrified and angry or upset.

    OP, why did you not think to move your car away from it once you'd first seen that it had been rolled. Surely you would have thought that at some point it would need be righted and therefor potentially cause an impact with yours?
