The ESA arrears are yours, the social fund is a separate entity, and whilst they will take deductions from your ESA on a weekly basis this can only be done on live payments/claims.
It is very difficult for the DWP to take back arrears, overpayments etc as the money that they award if for your current need, and cannot be touched (without notification)

cant be touched on current circs, when the circs change its fair game for them to recover all or part of the social loan or increase payments. so the answer to the original question is YES THEY CAN!0 -

You must be joking. IS/IB/JSA & ESA don't do that in practice, they haven't got the resources to do that. They action the change, whatever it is, and assume the "interface" cures all. They certainly don't go grassing up people to the Social Fund everytime they're due a bit of back money.I no longer contribute to the Benefits & Tax Credits forum.0 -
They can offer some of the arrears to offset against an overpayment...............but rarely do!!0

They certainly don't go grassing up people to the Social Fund everytime they're due a bit of back money. yes they can they have a duty to report to the social fund if a chance of cirumstances arrise that enables the claimant to pay off the arrears in either by increased payment, part pay off, and reduce payments,or repaid back in one lump sum.
as stated yes they rarely do this, but if the DM deems the circumstances have changed substantially in the claim that makes them viable they inform the social fund it's upto the social fund to follow up and make the decision based on a change of circumstance and get back to that DM in that case to either pay them the amount due out of the back dated or the social fund inform the claimant of increased payments due to new cicumstances.0 -

the ADVICE IS that they COULD.
Whether it WILL happen is another matter. the ADVICE is accurate.
if the OP gets all his money then great, but atleast they KNOW that IF there are any deductions and his social loan is paid then this is what has happened.
he then wont go on the phone and shout and scream you CANT do this because someone on a forum told them they cant when proof says they CAN.
you may not have ever seen this happen but i talk from my own experience of it happening to me, because YOU havent seen it done DOESNT meen THEY cant.
separate from what you havent seen, to the evidence that you can see.0 -
well ive decided IF my money doesnt get touched i wont be paying them back in one lump sum but will continue with my payments
to pay them off in lump sum would only please them

The point of this forum is to give accurate, current advice. Not to share anecdotes from your time claiming from the Ministry of Pensions in the year nineteen hundred and oatcake.
I'm telling you that benefit sections do not refer arrears cases to Social Fund for offset. They might have done when you were still in britches, but they don't now. So my advice to the OP is sit back & wait for the backdated money coming through.
