i have been successful winning my esa appeal but today i recieved a letter from dwp reminding me of my arrears i have with them (crisis loans) will they be able to claim my backdated money to pay off these arrears ? which im currently paying off !!:cool:

yes they can give the social fund first pickings of back dated money of any arears due up to them if they take them or happy with current agreement.0

No they can't.
The OP has agreed to repay those loans at £x.xx per week, not pay it back in a lump sum off arrears. The crisis loans will continue to be repaid at the agreed rate & the OP will get full arrears paid.I no longer contribute to the Benefits & Tax Credits forum.0 -
youll find in somecases they can, ive had it happen to me personally, back dated IB, £200 left on a CL because my then circumstances had changed they took £200 back out of my backdated as it was offered by IB as to whether they wanted it repaid or increased repayments as my curcumstances had changed.0

But wouldn't it be easier to pay it off out of a lump sum, rather than having to make regular payments that'll reduce your benefits?0 -
I recently went through something like this except mine was an overpayment and I asked if they could give me the backpayment as I was already in a repayment plan with them and they just paid the backmoney to me and just added 2 pound a week onto the amount i am paying back weekly.I did have to speak to a fair few people before they agreed to this .Maybe I was just lucky but I did say that if the medical hadnt been delayed so long by them not me then there would never have been such a high backpayment so there would not have been any question of them using it to pay the overpayment rather than give it to me .ITMSPaul Walker , in my dreams;)0

The ESA arrears are yours, the social fund is a separate entity, and whilst they will take deductions from your ESA on a weekly basis this can only be done on live payments/claims.
It is very difficult for the DWP to take back arrears, overpayments etc as the money that they award if for your current need, and cannot be touched (without notification)

Yes they can, well according to the DWP's own website they can

sourceEven if you are not getting any form of benefit or entitlement, you will still be expected to pay back the loan at the same rate which you agreed when the loan was taken out.
If you become able to pay off all the loan in a lump sum, you can do so.[greenhighlight]but it matters when the most senior politician in the land is happy to use language and examples that are simply not true.
