    The environmental search is not always optional, it depends on whether the lender requires it. (The CML Handbook can clarify). Not sure if it was the lenders or the Government who decided enviro searches should be done but solicitors are required to have them carried out even though they are not qualified to actually advise on them. At our firm we always include it in the local authority and drainage searches quote. We also don't charge extra for filling out the SDLT form which only takes a couple of minutes unless its a new lease when it takes a bit longer. I think there have been cases of litigation where an environmental search was not carried out and the buyers later found out their property was on a landfill or suchlike and decided to sue for not being informed which is probably why most solicitors like to have it carried out as a matter of course. At our firm if the lender doesn't insist on it then the client can request one not to be carried out (as I did when I bought and remortgaged).

    My mate just pointed out that in the not too distant future the seller will probably be required to put together an information pack with details of surveys and whatnot. It might not be a bad idea therefore to get the Enviro search done.

    Last question, I promise. Then I'll leave you all alone to enjoy your weekend! This SDLT form business.. is that Stamp Duty, erm, something Tax? Should I be paying for this form to be filled out given that I'm buying for £112k and so won't be liable for Stamp Duty?
