Scam: Buying item, reselling it and claiming it never arrived

If they don't sell the item for too much and don't use tracking I will buy it off them, say it never arrived and send it back to you at cost of postage.Have my first business premises (+4th business) 01/11/2017

Ask seller a question on their auction under a throwaway ID. Offer them stupid money to do a Buy It Now. When they reply you know they have it and have some proof (though nothing ebay would accept it may jolt your buyer when they realise its you!)0

I thought the seller retained ownership of goods until they were delivered. The buyer maintains this has not happened so who owns the goods?0
