o2 internet tethering and upgrading contracts

Just been on the phone to 02, wanted to switch internet tethering on for my iphone while I move house. Apparently I need to upgrade my tariff to a "2010" tariff and therefore lose my unlimited data which I don't want to do. Is this correct or are they just trying to get everyone onto the new tariffs? I was willing to pay another £10 a month but they've just lost out!

THey are correct. If you want to change tariff you can only change to a current tariff.

It may work but if O2 catch you at it they'll charge you at the out of bundle rates.

And yes they can tell whats consuming the data from the headers, but unless you really hammer it they won't bother looking.

You're unlikely to get charged, you will however be breaching the T&C and it'll most likely breach the fair usage policy on the unlimited data resulting in a bar on all data until your next billing date.

As Techhead says you can only add the tethering bolt on to 4th quarter 2010 tariffs.
